it happened at trader joe's. they have no cart ports

i put my groceries and my 7 month old son in the car, hopped in myself put the car in drive to pull forward and then i heard a big **s bang. i thought at first that someone hit my car but when i looked in my rear view mirror i saw the cart. so i put my car back in park got out and acessed the damage. left the cart where it hit my car, got my son, and went into the store to speak to the manager. the manager followed me outside to take a report and by the time we got outside someone had came and collected the cart. it broke my tail light and scratch my bumper and left red paint on it. the cart appeared as if it came from the side, off the curb, rolled about 30 feet into the back side of my car.

no, thats accidental under your insurance. and you park where you please. not the stores fault. |

Your could TRY to sue. I don't know about Trader Joe's, but EVERY store I have shopped at has signs posted stating something along the lines of: We accept no responsibility for damage caused by carts left on the lot. that is an attempt to escape such liability. Who knows what the court would say. |

It is not the store's fault that someone hit your car outside and not inside. Most stores have it posted that they are not responsible for
"lost, stolen or accidents in the parking lots. You might check with your insurance co. Just turn it in and have it fix. Suing has become the way of America and it is shameful. Everyone thinks that they can get rich quick by suing somebody over little stuff. |

I need more details. Did you hit the cart, or did the cart hit your car? Were you driving in the lot when the car was hit, or was your car parked? Was someone pushing the cart? Did someone bump into the cart and make it roll into your car? |
