If in a church business meeting the members do somthing that goes againt church by laws is it illegal?

A churches by law states that every member is to be given a pastoral survey. In a business meeting the members who were present decided to only hand out surveys to members that were present. This was done without changing or amending the present by law that states that EVERY member is to receive one. There only explanation is that that is the way they have been doing it for years. So have they been doing this illegally for years? If so is there something that can be done legally to stop it?

The bylaw clearly states that every member is to receive a survey,not only members who were present at this meeting. They clearly added to the bylaw without doing so in a vote. There are members who work , members who were sick,,and members who simply want to stay away from these meetings because they dont want to listen to people belittle,snap and degrade each other at these Wednesday night meetings and then see those people go to church on Sunday and act like what they did was ok ,and they are ok. Those facts do not take away from there rights as one of the "every member is to receive a survey" member to have a survey so they can support the pastor with this survey. As far as the statement that is has been working for them all these year,,thats very debatable.

nothing can be done legally except going through whatever processes are set in place by the church

bylaws are set by the organization not the state or federal gov. so legally you can't do anything unless they all sugned some contract stating they would abide by the set bylaws

The only suggestion I can come up with is to take initiative, make copies and try to get volunteers to pass them to the ones that don't seem to care about being informed or they would have shown up for the meeting. Now this excludes the ones that had to work or sickness or other good excuses for not being there. I have faced the dilemma where the only time some want to be involved is to complain, and I'm not insinuating this is the case in your situation. Just a suggestion, don't involve the courts. When the people care, they'll act as though they care, otherwise your fighting a lonely battle.

doesnt sound like a case thats winnable. theres only two laws. one that you can prove, and one that you cant. doesnt really matter if its down on paper if nobody can prove it or enforce it.

Company or organization by-laws are not LAWS. They set forth how an organization is to be run. They are not enforceable with criminal penalties.

However, if you do not get any resolution within your organization, you might wish to pursue the issue in a Civil Court. Civil Court is where individuals can get resolution to a conflict from the government. No one can go to jail, but a civil court ruling is enforceable. The downside is that if you take your church to court, you risk being shunned.

Another option may be the Church hierarchy. Can you go to the local Bishop (or equivalent) with your complaint?

They are fine, they are passing out the survey to the members who have enough concern to attend the meetings. They could pass them out to the church members at church but they may not get them back or they may not get accurate feedback from one time visitors. It is that body that is running the church so if that is what they want to do, I would let them, it must be working for them.
