I'm 62 years of age. An attorney friend brought to my attention that I may have benifits available to me. Could this be so? Becoming recently disabled, this would help greatly.

Only those who are LEGALLY American Indian qualify for benefits and services reserved for American Indians. The legal requirements are:
1) An enrolled member/citizen of a US Federally Recognized Tribe
OR
2) 1/4 or more Indian BY BLOOD with proof via Certificate of Indian Blood
So, assuming you are not Native By Blood, option 2 is out. Option 1 can still be an option though if you can become enrolled in the tribe of your stepfather. That descision though is entirely up to his tribe. Until/Unless you are enrolled you do not qualify for anything.
And for those who think that tribes do not enroll non-Natives, look at the case of the Cherokee Freedmen. They are not Cherokee at all but are Black. However, the Cherokee Nation has, in the past, allowed the former slaves of the Cherokee Nation to become full citizens of the Cherokee Nation. As such, Cherokee Freedmen qualify for benefits and services reserved for American Indians because of their CITIZENSHIP. Granted, the Cherokee Nation is now taking steps to remove the Cherokee Freedmen because they are NOT American Indian, at the present time they are still considered citizens of the Cherokee Nation of Oklahoma. |

I believe it depends on the tribe's bylaws. Some are stricter than others. I recommend you contact the tribal council and ask. Make sure you have your stepparent's tribal registration information at hand, as well as any paperwork regarding your adoption; if you don't, it will make things very difficult. |

I suppose you'll have to see the tribe's counsel on that. I doubt it comes up very often. I'd say yes, but I can't be certain. |
