If my parents have been intercepting my mail, is it considered mail fraud.?
Find answers to your legal question.

If my parents have been intercepting my mail, is it considered mail fraud.?

I AM over 18, but still living with my parents. My dad shares the same name as me, but knew that I was expecting a package (he was not expecting one for himself). He intercepted the package on Saturday, and hasn't told me a thing about it. He acted like nothing happened for two days.

He hasn't come home yet, and I don't have a means of contacting him until he does.

Is this mail fraud? I am sick of him pulling crap like this.

To Aram T. I am strongly considering reporting them. I have told them many times to cut it out, and I've warned them that I'd report them, I just don't know if I can.

Mail fraud is using the Postal System to break the law - sending drugs, those you won a million $ if you send us $1000 schemes etc.
Theft would be taking mail out of someone else's mailbox. Opening mail not addressed to you is tampering- still illegal.

Try asking your dad if he got the package first. He could have honestly forgotten about it. If he denies that he has the package and it is in his possession then that's larceny.
If you can't afford a PO box then try adding something to your name like a middle name or initial of Jr. so that it clearly shows you are the recipient .

Try working it out with your dad first. Life might be kinda awkward at home if you have your dad arrested.

You can report him.
He can evict you.
If a person living in my home was getting packages, and had an attitude about it.. I would wonder if they were not having ammunition or other crap sent to my home.

Evilest_Wendy
I don't think so. Get a PO Box at the post office. Then you don't have to worry about it.

well, if you paid for what ever it is, you should get it. so confront him about it. i'm not too sure of the legalities, but what ever it is, you have the rights to the package, so i would talk to him about it. or you should start intercepting his mail, like bills and such lol. jk no don't do that.

If you share a name, then there is no way to prove he did it on purpose, even though you may be sure.

fraud NO
theft possibly.....

if you share the same name...and you are a Junior...have everything addressed To... Your Name JR.

OR...get a mailbox, at the Post Office.....
and have all your mail sent there.

Easy solution.....

I was going to say something about your age. But since you are over 18, I believe that your Father intercepting your mail and treating it as if is his own, is akin to an adult roommate doing the same.

I doubt it's considered mail fraud for legal purposes, and if it were, would you press charges?

You might want to consider getting yourself a Post Office box... problem solved, no grief.

no!! his house??? his mailbox??

he can look, but he can not open ( or better said should not) your maill!! but I know parents like to snoop....so get your own PO box....!

It's definitely mail theft if he keeps it or if he opens it. You should ask him about it as soon as he gets home, it's your package not his.

Maybe (NOW EXPECTING)
Yes, if they open it and your legal and it has your name only on the envelope.

Not fraud, but invasion of privacy

I'm not sure the legal term but if you an adult it is illegal for them to open you mail. You can call your post office to find out what you can do about it but you might want to just get a P.O. box if your father is going to continue to disrespect your privacy.

I have a 19 year old daughter living with me and I would never even think of opening her mail.

not if your mail is being delivered to his home that he owns

Technically, it is. But proving it is another matter, particularly given that you and your father share the same names. And even if you didn't, it would still be difficult to prove it.
Best advice: get a p.o. box, or, better yet, get your own place with your own mailbox.

Sometimes my parents and I get random packages in the mail. Maybe that's what he thought it was and just decided to wait to open it. Ask him about it, and while your at it, mention to him that when he intercepts your mail if he could, say, put it on your dresser that you would appreciate it.

You and your parents share the same mail box. So whomever gets the mail is technically intercepting everyone else's mail too. They could just get mixed up. Try to work out a way you can make sure the mail is separated before it disappears into the trash or your parents' bedroom. Maybe they could leave the mail on the counter and you can get yours when you come home.

It's not considered mail fraud, it's mail theft.
It might be your dads way of telling you that it's time to get out & pay your own bills. After all, you're over 18, right?

Unless parents are suspecting that their kids are getting into something "unethical or dangerous...etc. " they should treat them with respect... and leave their mail alone...
Start using your middle name for "mail purposes"...
also ask your parents straight out, if maybe they want you to move out ... ???

Fedup Veteran
If you are over 18 then, YES, it is mail fraud. Period. It doesn't matter if you have the same name and live in his house, if he doesn't let you know that you got a package and that it wasn't his then it is fraud.

I agree with the first answer as far as his opinion about getting a P.O. Box.
