Very unlikely unless they expose the kid to the illness by being reckless or on purpose.
All vaccines have some side-effects and the pertussis vaccine has been blamed for many adverse reactions and even deaths when parents were "forced" to get the vaccine for their kids, this also led to many lawsuits. So today the Government is not too willing to take the blame, and they prefer to let the parents decide if they want to use the vaccine or not after learning the risks; of course this might change in the event of an outbreak. |

Well I dont know about laws in Australia, but in the US, you might get charged for child endangerment and manslaughter if the child was old enough to be immunized. |

i doubt any public prosecutor would make such a charge.
the more interesting case is the one of the 12 month old [who isn't old enough to be immunized against many things] who dies because he gets an illness from an unimmunized 4 year who lives next door.
now, can the parents of the 4 year old be charged in the death of the neighbor's baby? |
