If somebody goes to jail for breaking a law that's later repealed, are they let out of jail?

It seems to me they would be, because they would have been breaking an unjust (or unconstitutional) law, which the founders actually encouraged.

that would depend on how the law is repealed.. like in the new stuff that is going on with AIG.. they tryed to make a new law and tax them on their bonuses.. but couldn't cause the law is NOT retroactive..

They are not automatically let out. They can appeal to the prosecutor to take another look at the case, maybe they can get the case reopened to have the conviction, and then the charges dropped, or they can ask the governor for amnesty.

No if the New Law came out today , it would only be for people who broke this law today,

sometimes but oftenwhat the law is at the time is the crime you committed, they say there are still people in prison for a few joints since the 60's.


lady caty, did you see AIG has control over much of the insurance for private contractors in Iraq and when they get hit with a roadside bomb AIG has been trying to get out of the settlements even after making a sheer fortune for insurance.
