If somebody pays somebody else to attack a person (me) can that person be prosecuted or only the attacker?
Find answers to your legal question.

If somebody pays somebody else to attack a person (me) can that person be prosecuted or only the attacker?

I think someone is trying to get me beaten up, but that person themselves wont be doing it, theyl be paying someone else to.

Can they be prosecuted for this, or can only the person they payed to beat me up be prosecuted?

Thanks :)

LYN W
Hi,
The person who attacked you is guilty of the assault and the person who told him to do it is guilty of conspiracy to comission a crime.

Both get prosecuted but the conspiracy charge will be more difficult to prove.

Hope this helps

Good luck

The person who hires a thug will get a longer sentence. If you are certain about getting beaten up then go to the police & try to keep some one with you.Good Luck

Both can be prosecuted.

They both can get prosecuted! one planed it and the other one acted on it!

If there is proof that this person was involved, then yes, because he instigated the crime, it's like someone hiring an assasin, they are guilty.

yes they can be but it will be hard to prove it unless the hired goon admits it.

They will both be charged - have absolutely no fear of that.

Really hope it doesn't come to it mattering.

both of them can, go and speak to the police, let them know your concerns, if you are that worried go and see a lawyer, in the UK first 20 minutes are free, see what they say, get a restraining order, make sure you always go out with someone, never on your own, keep safe, all the best

Oooo- are you in hot water again young man?
Technically, you would have to prove to the court that this person who came and beat you up was hired by this other person .

To avoid getting hurt, which is the most important thing (be proactive !). I imagine you have to yell to anybody who looks like he will beat you up "Wait ! dont beat me up, I will double the price he paid you. Do we have a deal?" or " Wait, dont beat me up, I will double the price he paid you for you to beat him up !"

Sigh. or just stop whatever it is that you are doing that the other guy is getting mad at you for. Hire a bodyguard maybe?

you can get them both but you will have to have proofe. otherwise you will probably make the situation a whole lot worse in the long run.

vdv_desantnik
the person doing the paying can get done for conspiracy as well which carries a similar sentence

cascasperjasper

Of course both will be prosecuted.....take the case of a contract killing....clearly the payer for the service is also deemed guilty in it...

It is very true that proof is another thing.......and without the goon being caught and confessing then what chance of a link do you have....

I'd go and keep low for a while.....or let the police know now your concerns and make the person you think is arranging this know that the police have already been told yopur suspicions....

Northernbloke
Both will be prosecuted.
A criminal act has two parts.
The Actus Rea and the Mens Rea (legal Latin phrases)
The actus Rea is the guilt act, actually committing the crime (the attacker).
The Mens Rea is the guilty mind, so it the thought about the crime (the person who engaged the attacker).
Hope this helps.

Both will get done, why not beat them to the punch, and get a pair of Dobermans. See how the coward and his hitman like that. Mick

QueenLori
Yes, the person who pays another to assault someone different can be prosecuted.

Both will be peosecuted. If you're really worried go to your local police station and tell them your fears are real and ask what to do if it does happen.

Uh, hello?!?!?? Do the names Tonya Harding and Nancy Kerrigan ring a bell?

Yes they both can be prosecuted. However if the person who paid the other is proven guilty, their punishment can be worse.

both will
