If the ex gave the BF a gift, it belonged to him and he could keep it, sell it, trash it or give it away as he saw fit. If it was not a gift, but was loaned, then he had no authority to give it to you and the owner is entitled to recover it. If you are asking me if it was a gift, I don't know. If you are asking me if a jury will believe it was a gift, I don't know that either. |

If it was given as a gift, then it is yours. There is no legal obligation for you to return it if they later want it back. |

It depends on the reason the thing was given in the first place. If I gave some guy a gift just to give it to him, then there are no conditions attached to the gift. So he could do whatever he wanted to with it. But if I gave him something for a specific reason, then there are conditions attached to that gift. So if those conditions don't exist anymore, which they wouldn't if he were going to be giving that thing to someone else, then he should give that gift back, or at least offer me the chance to take it back.
The fact that it was a gift matters, but the intention of the gift is what matters more. If I gave someone a gift with the intention that it was just supposed to be for them and they knew it, then if they didn't want it anymore they should give it back to me, or at least ask me if I wanted it back. That is a gift given with conditions attached to it. In that case had I known or felt that they would give that gift away someday, then I might not have given it to them in the first place. Some gifts are given with conditions and some are unconditional.
Why don't you be specific about what the gift was and why she gave it to him, then I can be specific about whether or not he should have given it away. |
