Well, your first punch was self defence and you can argue that you had to make sure you put him out of action as you were afraid he might start it again,which he may have done , considering he started it. I have done that and my argument was accepted. |

It depends at what point your response is witnessed. Remember fighting with your brother...he would always start it, but mom would also arrive as you were finishing it...and that's right you got sent to your room, while your bro laughed his butt off and planned his next entrapment assault on you. |

You defend yourself against his punch, after that has been achieved, further action by you is assault.

The law states that reasonable and equal force may be employed in defence.
So if he hit you once...then you hit him on multiple occasions...you could be in trouble. Pre-empting an assault is not a defence of any real value I'm afraid. |

Since the person punched you a single time & you beat ++++ out of him I do not believe that would be considered self defense. But it could depend on the state you live in & how they interpret battery, assault & self defense.
They may see it as assault or battery because you did NOT defend yourself, you admit that you beat the other person up. I think that goes beyond defending yourself when the other person hit you a single time.... |

Most likely assault. Up to the Judge (jury where appropriate) to decide. Ask yourself did you need to beat the ++++ out of him so that he couldn`t punch you again. Is beating the ++++ out of someone on a par with a punch? You say you knew you`d be punched again. How did you know this? You can see there are many questions to be resolved. This is not an easy scenario to come down one way or the other. |

If you are attacked you have the right to defend yourself. This means using no more force than is reasonable. So if you hit the person once and they stopped attacking you then this is ok. If however you continue to hit them when the threat to you has subsided then you are equally as guilty of assault. In this case you may both be charged with affray. |

If you were punched just the once, then that is retaliation, which is assault and at worst depending on the injuries inflicted GBH. If it was persistent punching the self defence is would stand. |

assault, plain and simple. You stated that you beat ++++ out of him after he punched you. How is that reasonable force? you should have walked away and called the police. But I guess that wouldn't have been the cool thing to do eh? Same old story I've heard a thousand times before. Try some anger management courses. |

This comes down to the word reasonable. Reasonable force will have to be sorted out in court. If you went over the top when you beat the other person up, you may well be done for assault. Your best bet is to contact a solicitor for furhter advice. |

To my understanding if he threw the first punch and you fought back it is self defense......It helps if you have witnesses that saw him through the first punch |

It depends on if you stopped beating him up after he stoped defending himself. I know that sounds wierd but, if a person cannot defend themself then they are being assulted. Now if you beat him up for a min. then left him alone, then yes you defended yourself. But if you beat the crap out of some guy that just punched you and got punished for it, You might be in a little bit of trouble. but I wasnt there so I dont know. Good Luck! |

this is gonna be a case of whether you used "reasonable force" to subdue your attacker or did you go over the top. you can punch someone to stop someone attacking and then leave which is reasonable or you can, as you say, beat the **** out of them in retaliation which will probably be more than reasonable force.
if it does go to court i would recomend getting a good soliciter. |
