Texas,,,,yes and you're screwed. Seven years ago my son was arrested for one joint in Houston, he lost his drivers license for six months plus a fine. That was just the beginning, because of this misdemeanor possession arrest on his record, he has been denied apartments, jobs and schooling. That was seven years ago, he still being turned down for apartments, jobs and schools. The law allows for misdemeanor drug arrests to be treated the same as felonies for these things.

Ironic though,,,, one of the apartments that turned him down rented the apartment to a guy that turned out to be a sicko and raped three women in the complex. Who would you want living next door you, a pothead or a rapist?

While it depends mostly on the state in question, generally if you get caught in the act of smoking weed you will be issued a notice to appear, and yes it will go on your record. You will not be able to obtain a college loan, or be hired for certain jobs (this is of course assuming that you plead guilty).

However, find a decent lawyer and 9 times out of 10 they will be able to get the entire case dropped on some random loop hole - The officer got your height wrong, or in some way managed to incorrectly file paperwork - or probable cause was not there.

Either way, its smart to be smart about smoking weed. If your going to do it, make sure your in a private place, away from the possibility of being ambushed by officers who care more about people being harmless to themselves and everyone around them, rather than the guy raping a house wife down the street.

You will, however, if you only have a small amount, not intended to distribute (sell), it's only a misdemeanor. It only becomes a felony (which is obviously more serious on your record) when the weight hits a certain amount, or if your packaging to distribute (sell). Hope that helps. Cheers.

Yes; 2 ounces or less is a Class B misdemeanor.

With no prior felony convictions, if convicted of possession of less than one pound of marijuana a judge must impose a sentence of probation with mandatory drug treatment. If no treatment center exists within the jurisdiction, the judge may waive the treatment requirement. They judge can also waive all fines.

If you are caught and convicted of being in possession of an illegal substance, such as weed, it WILL go on your record. The penalties for possession vary from state to state.

If you aren't in possession of a substance, and the cops suspect you of being high, but you aren't doing anything to harm anyone else, such as driving under the influence, the cops can't do anything about it. They can't penalize you JUST for being a dope addict. You have to be doing something under the influence or in possession at the time.

Naaawhh, A citation. Well actually it depends how much, if you have more than the allowed amount I THINK they can arrest you.

You BET! They'll be SO PLEASED to give you a criminal record - Then you get to waste the time of from 3 to 12 DEA agents who will take you to court and then to prison.

Legalizing pot would put these DEA agents out of work along with a lot of prison guards.... That's one reason it remains illegal.
