If you think abortion is murder, would you retrospectively prosecute women if the law changed?

If abortion was made illegal, would you start prosecuting the women who'd had abortions? Of course, there is usually a presumption against retrospectively prosecuting people when a law is changed; but for very serious crimes involving murder, exceptions are made. After all, Nazi war criminals were pursued for decades after WWII.

Note: I myself am pro-choice, but I just think that people who claim abortion is murder rarely think about just how serious that allegation is. I'd be interested to see if there are some people who would want to jail women (and the doctors who treated them) who had legal abortions.

Geoffrey D - I live in a country which has no constitution, so your response is geographically limited in its application. However, you seem to be suggesting, on the basis of this constitutional principle, that people murdered slaves when it was legal should be protected from prosecution. Well, it's precisely outrageous suggestions like that which make me glad that I live in a country where there is only a general presumption against post facto laws, with room for the very, very occasional exception.

No, if they did it before the law changed, they committed no crime. Comparing that to war criminals is not really a good comparison.

What you refer to is a "POST FACTO" law.

And the Constitution prohibits prosecution for crimes before a law was passed making something legally a crime.

Although abortion isn't LEGALY defined as a crime at the present time, you need to keep in mind that, as our society becomes more civilized, it should eventually be recognized for what it is:

THE MURDER OF AN UNBORN BABY.

Keep in mind too that it was once LEGAL [though not moral or right] to MURDER a man, woman or child

AS LONG AS THEY WERE BLACK SLAVES.

It was also once LEGAL to deny women the right to vote and other rights.

Aren't you glad that's all changed?

Won't you likewise be glad when unborn babies are likewise afforded legal protections from homicidal parents?

I'm sure there are some zealots out there that will say yes but the truth is, it was not an illegal act when committed and it would be impossible to do so.

No, and you can't do that, changing a law or creating a law only takes effect on the date the president signs it into law.

if abortion became ilegal then the world is poorer place...women should be allowed to make the choice.

but there are no plans to make it ilegal just to shorten the time in which you have to make the decision to do it.

plus if they did make it ilegal would I have to stop eating eggs.

I will clarify first of all that i am too pro-choice,but welcome the decrease in the amount of time there is to obtain an abortion,24 week's is simply too late.Does anyone imagine that those women that have had an abortion at 24 week,s(remember it is over half way through the pregnancy)simply used it as "a morning after-pill form of contraception?I think not,to obtain an abortion at this late date you have to "jump through hoop's" it is not simply given to you,and many women at this stage do have to pay to go private.To the answerer that implied it would be a good idea to stop allowing abortion's on the NHS,I ask this do you really want backstreet abortionist ripping women's insides out on dirty kitchen table's?What a good thing that would be!To even compere a woman's anguish at having to abort a child that has been a living breathing thing inside their body for over 5 months, to that of a cold blooded murderer frankly makes me feel sick to my own stomach.

as others have already pointed out, no woman would need worry about being prosecuted after-the-fact for a crime not yet leally defined as a crime till, let us say hypothetically, the year 2112.
but the ACKNOWLEDGMENT of the gravity of the offense, by according the same serious of murder to an unborn baby as to one newly-born, would serve to prevent women from murdering those babies almost as much as it does to prevent them murdering them after birth.
have you ever seen a video showing how BRUTAL the unborn babies are murdered. with forceps ripping off their arms and legs, and CRUSHING their tiny skulls? How can i sympathize with a homicidal parent who tries to murder her little baby daughter or son by a "back street" abortion who gets herself killed too? that's about like having sympathy for a terrorist who gets himself shot trying to kill others.

Retrospectively, no. Maybe not even afterwards; but how is it possible for anyone not to see abortion as murder, or at any rate, justifiable homicide?

Exceptions are NEVER made for ex post facto laws. This is a very fundamental principle of our legal system.

Remember that British ex post facto laws was one of the main reasons for fighting the Revolutionary War in the first place!

I am sure there are people who would bluster what you ask them to here - that would only say they didn't even understand what was taught to them in third grade history class, which makes everything out of their mouth suspect.

You're right on one level. Murder has no statute of limitations. However, you can't retroactively apply a law. You can charge someone with an offense that didn't exist before the offense was created.

I kind of doubt that pro-lifers want women prosecuted. They're likely to find criminals in their own families, since one out of three women has had an abortion in her lifetime.

to remove a live baby from the womb, by dissecting it limb by limb, is this to be seen as contraception? i agree that women should be allowed this choice, but i would bring it down to 8 weeks and no longer.

Any 'woman' who could kill her baby, knowing that it would be torn apart limb by limb, or burnt alive by chemicals etc(you get the point), is not worthy of even being called human because only a cold blooded psycopath could committ such an act. May any 'woman' who has committed this crime feel thier babies pain a millions times over-because karma will come for them.
