An undertaking to do an act that entails more than mere preparation but does not result in the successful completion of the act.
In People v. Lee Kong, 95 Cal. 666, 30 P. 800 (1892), a case from the Supreme Court of California, the defendant was found guilty of attempted murder for shooting at a hole in the roof, believing his victim to be there, and indeed, where his victim had been only moments before but was not at the time of the shooting.
In criminal law, an attempt to commit a crime is an offense when an accused makes a substantial but unsuccessful effort to commit a crime. The elements of attempt vary, although generally, there must be an intent to commit the crime, an overt act beyond mere preparation, and an apparent ability to complete the crime. |

Go to your local courthouse. People are convicted of attemting crimes every day. BTW, the case mentioned above, in Ely, NV, resulted in a reversal by the Nevada Supreme Court as they held that there can be no attempted manslaughter because an attempt is a specific intent crime and manslaughter is not. |

I wish I could give you a more definite answer such as the case number or even a close date but a case I recall that was heard in the Court in White Pine County (Ely) Nevada somewhere in the mid to late 70s was on an attempted manslaughter case. The person was tried on "Attempted Involuntary Manslaughter"; I could never figure out how a person can attempt to do an involuntary act but it got into court. The incident occurred when a coup[le living in a manufactured home got into an argument, the lady left the house, got into the mans truck and started to leave. There was a rifle in the truck so she stopped and fired it into the house several times. When the man did not come out she went back in and she had wounded him. She called an ambulance and was later charged with "attempted involuntary manslaughter." The good old days are gone! |
