He only wants him when it's convenient now that he has a high school girlfriend. (He's 26) I let my son go with him until about 6 weeks ago because he refused to bring him home on time. I asked him to have him home by 6:30 because my son is in kindergarten (all day) and I make him lay down at 7:30 even though he doesn't usually fall asleep til about 9:00. He said I'm abusive bc I make him lay down at that time and didn't bring him home til 10pm. Anyway everytime he takes my son he drops him off with other people so that he can spend time with his girlfriend. My fiance and I don't think he should go with him until we get a lawyer and go to court because we're scared that he might not bring him home. I know for a fact that if that happened, there's nothing I could do about it til we went to court. I just need to know if I'm wrong for this in a legal sense. Thanks

There is not a visitation order. We haven't gone to court.

What does the visitation order say? If there is no visitation order, then you do not have let the father see the son. If there is, you need to obey the order, regardlessly. |

In order to settle this, you would be better served to have a visitation court order in place, the court order is enforcable and is legall binding. When there is no order in place, nothing illegal is being done. For the sake of the child, you need to have a legal court order in place. |

You need a lawyer, and need to let Family Court (or whatever the court in Oklahoma is called) resolve the question for you. I do know that you should have your custody and visiting arrangements approved by the court. |
