In what ways is the Americans with Disabilities Act not upheld?

To clarify... No act is upheld to the fullest degree that it should. It is simply impossible. For example, it would cost billions of dollars to make every single building in the United States accessible. So my question is: What is wrong with the ADA, are there things it doesnt quite cover, and how can it be improved?

The ADA was recently amended to fix some problems--mostly resulting from U.S. Supreme Court cases that narrowed coverage. A couple of things that could be changed now would be a more effective enforcement mechanism. The EEOC, for example, has a huge backlog of cases, meaning huge delays or lack of actual investigations prior to issuing right to sue letters. Another issue is coverage of smaller employers. Currently Title I of the ADA only applies to private employers with 15 or more employees.
