Is Holocaust denial illegal in the US or is the value of freedom of speech greater?

A British Historian was jailed after being found guilty of Holocaust denial at a trial in Austria. He disputed the existence of gas chambers at Auschwitz. A number of European countries have laws against Holocaust denial but would the distortion of such a fundamental period of history greater than the right to express contrary interpretations - however unpleasant, and indeed inaccurate, they may be.

No, it's not illegal to say the Holocaust didn't happen, in the US. Though people that really believe that it didn't happen are in denial. |

In the U.S. it is totally legal to deny reality, including the holocaust. You can make yourself a public idiot if you want to.
Our constitution assumes that if we have the brains to govern ourselves, we have the brains to find out the truth.
As Lincoln said, you can fool all of the people some of the time, you can fool some of the people all of the time, but you can't fool all of the people all of the time. |

It is completely legal to deny the Holocaust in the US.
It is also legal to deny the moon landing and to believe that Area 51 is where the gov't is holding captured aliens.

Freedom of speech completely over rides Holocaust denial. Making something like that illegal is taking a step towards fascism. I think people who want to make laws against Holocaust denial should learn more about World War II, so they can know when we're starting to head that way again. |

The value of free speech is greater. |

In the US, free speech trumps. I think that the Austrian business was foolish and wrong-headed; the denier was of course a fool, but it is not unlawful to be foolish. (If it were, we would fill up the jails rather quickly.) |

The First Amendment guarantees the right to deny the existence of the Holocaust. Basically, you have a Constitutional right to voice just about any asinine viewpoint you can think of.
And if you don't believe me, fire up C-SPAN and take a gander. |

The freedom of speech is greater. In the united kingdom you could be prosecuted for the use of the N word did you know that? |

In the U.S. it is not a crime to have an opinion, no matter how wrong that opinion might be. |

I don't know if denying it is illegal or not but it is pretty damn mean!!! I mean, it was a terrible thing and by someone denying it happened is obviously going to get a lot of people mad and upset!
Sometimes it's not a question of politics but rather one of morals and humanity. |

Free speech is more valuable. If someone wants to deny that six million people died at the hands of a murderous f*ckhead (in the words of one Eddie Izzard), that's his or her business. Thanks to freedom of speech, everyone else can call that idiot a f*ckhead as well. |

If it is illegal I know someone who needs to go to prison. |

hmm, I thought the freedom of belief allowed Americans to believe whatever they wanted to believe in as long as they're no danger to others. There are after all people who still think the world is flat and I don't think they're jailed because of it. |

Anyone can deny anything they want about the "HOLOCAUST". They are free to do so. That doesn't make them right!!
My father was in WWII and his unit was one that had the dubious honor of liberating TWO MAJOR DEATH CAMPS; ORDUFF and AUSCHWITZ. Wanna see the photographs he took? Wanna get sick to your stomach?
Wanna see what a HUMAN BEING looks like who hasn't had a real meal in YEARS ??
Wanna see prisoners digging their own graves?
How about Prisoners being MACHINE-GUNNED and falling into a LIME-PIT ??
Wanna see what a NAZI looks like when his head was beaten in with a milking stool by some prisoners?
Wanna see the OVENS at AUSCHWITZ ? I HAVE THEM ALL !!!
WOULD YOU LIKE TO SEE A MAN WHO WENT THROUGH HELL AND BACK TO SAVE THOSE PRISONERS AND STILL HARBORS THE SCARS OF WHAT HE WITNESSED?
I can assure you, the movie "Saving Private Ryan" was a cake walk compared to what my dad witnessed.
DON'T EVER TELL ME THERE WAS NO HOLOCAUST.
'NUFF SAID ! ! |

Unfortunately it isn't illegal. We have free speech for a reason but free speech has its consequences. I believe Mel Gibson's father is an Hollocaust denier. |

You can say just about anything in U.S., like, "How come, when you look the word "holocaust" up in the dictionary, you don't see a picture of Auschwitz drawn next to it?" |
