Find answers to your legal question.

Is Nancy Pelosi guilty of sedition or treason, using these definitions:?

Treason. A breach of allegiance to one's government, usually committed through levying war against such government or by giving aid or comfort to the enemy. The offense of attempting by overt acts to overthrow the government of the state to which the offender owes allegiance; or of betraying the state into the hands of a foreign power. Treason consists of two elements: adherence to the enemy, and rendering him aid and comfort. Cramer v. U. S., U.S.N.Y., 325 U.S. l, 65 S.Ct. 918, 9327 89 L.Ed. 1441. See 18 U.S.C.A. § 2381. A person can be convicted of treason only on the testimony of two witnesses, or confession in open court. Art. III, Sec. 3, U.S. Constitution.

SEDITION - Conduct which is directed against a government and which tends toward insurrection but does not amount to treason. Treasonous conduct consists of levying war against the United States or of adhering to its enemies, giving them aid and comfort.
Additional Details
#1: Nowhere in her job description does it give her the power to usurp the position of Secretary of State.

#2: "giving aid and comfort to the enemy", includes making foreign relations and policy statements on behalf of the executive branch of which she has no authority to do so.

She is guilty by reason of usurping the authority of the executive branch of government.

As far as the republican congressmen with her on this trip, I have yet to hear them make statements regarding US foreign policy, as she has. Perhaps they will be the witnesses needed to bring charges against her since they are there on a fact gathering mission.

Treason: first point: "overt acts to overthrow the government of the state to which the offender owes allegiance" - She is certainly trying to bring down President Bush and the policies of his administration, which he was elected to enact. Whether that fits the bill is in the eyes of the beholder. If I were on the Jury, I would find her guilty, but I'm sure they would never let me on the jury.

Treason: second point: "giving aid or comfort to the enemy" - That is a no-brainer. All the democrats in leadership positions are guilty of that one without a doubt.

So MY vote would be GUILTY of Treason, but would probably not pass through the entire jury.

Sedition: Since this is an "OR" question rather than a "AND", the second qualifier "giving aid and comfort" is clearly satisfied. GUILTY. GUILTY. GUILTY.

The question is moot. The Bush administration is more interested in "getting along" with the people pledged to bring it down than it is in investigating violations of our national security.

If Sandy Burger gets off with a wrist slap, and the NYT is not even investigated for leaking secret info, what can you expect to be done? Simple - NOTHING.

If she's gullty of treason, then so are 3 Republican Representatives who've previously met with President Assad. One of them is Rep. Joseph Pitts of Pennsylvania.

No, she' not guilty. This is part of the 2007 Mideast tour
She's the Speaker of the House and she's not the only one.
Three Republican congressmen — Frank Wolf, Joe Pitts and Robert Aderholt — met with with Syrian President Bashar Assad earlier, although the Bush administration asked Pelosi, as the leader of the Democratic Party, not to visit a state sponsor of terror.

Bush is the hypocritical one.

A February 5, 2007 Rasmussen Reports poll showed Pelosi with a 49% approval rating and a 40% disapproval rating. This made her the most popular of all House Congressional leaders in the poll, and the only one with a net-positive approval rating.

I would say she`s guilty of sedition. She`s also guilty of a bad face-lift, chicken legs, and not having a clue.

Answerman
Shes guilty of being a damn good speaker of the house, getting facts instead of lies from the Bush administration. .

I would say sedition, it was very unwise for her to visit Syria, who has been a enemy of our country for many years and who is responsible for insurgents murdering journalists, aid workers and our soldiers, by aiding the insurgents in Iraq and Afghanistan. I really liked Nancy Pelosi, now I don't trust her at all.

No.

I note that she did (presumably) travel on a government aircraft, and that she was granted a valid exit visa.

These slanderous questions on America's finest elected official are getting tired.

They are asked over and over again, and yet you still are either so filled with hate for women, or just plain too lazy to go out and actually do something that you sit here slapping Americans across the face with these un-American questions.

You should be ashamed of yourself.

Love America and it's ways or leave.

Better yet, go and enlist so you can fight your un-elected president's hate wars.

She represents the American people more than Bush or Condeleeza rice. This is why we elected Democrats into office. Bush even said he represents only the people that voted for him. And with such a low approval rating, he doesnt represent the majority of America. Bush is supposed to represent the whole country not just the fools that voted for him.

If she is guilty of treason then so are three republican representatives. The meetings in Iran were bipartisan.

She is third in line to president and the representative of a predominantly democratic House majority. I am not sure how you equate her visiting and nation that firstly we are not at war with and secondly has not threatened us, and finally has not been sanctioned is treason.

she is guilty of one thing: being stupid.

Nice argument, but the one problem with it, is that you are assuming that George W. Bush IS the government. That is not correct. He is but one person of one part of a three part system. OK, he is the leader of that one part, but the executive branch is not the entire government. There is the judicial branch and the legislative branch. Pelosi is a co-leader of that branch, and the main purpose of politicans is to speak for the people they serve and to act as a diplomat to other countries. Something that GW refuses to do, even though He started this whole mess, not Pelosi.
