Depends on your state, but in my home state it was in the criminal code as a crime. It is hardly, if ever enforced. It's reserved mostly for contested divorce cases and sensational tv shows. |

Yes there are some states with laws against adultery on the books. I don't think many states enforce it though. |

Oddly enough there are laws against adultery on the books in a few states; Michigan comes to mind. Go to your state homepage for your legal code and search the statutes for the word. |

There are a couple of States that allow the person who was cheated on to sue the cheater for "alienation of affection". Rarely does anyone do this though.

Some states recognize a civil tort called "alienation of affections" where the third person could be sued by the cuckolded party for ruining the relationship. |

If it is not illegal in your state it should be. I feel that if it is immoral, illegal or fattening you should not do it. |

i think there is...... generally its ground for divorce and also in lots of prenuptial agreements the non cheating spouse is better off if adultery has been committed..... and a few recent cases have gave money to the individuals who affections have been lost for.......... say A and B are together and A decides shed rather be with C...... B ends up getting money and since we with the exception of Louisiana practice common law...... really its less books and more what else has happened but I'm sure some states have specific laws against adultery...... |

Obviously it is an immoral thing to do regardless you being a Christian or not. It's quite interesting that you bring up this question, because in other countries, as far as I am aware, there have been laws against it, and not only that but laws which are strict and very consequential. I know that in some Middle Eastern countries up until the 90's you could have your hand removed. However in a country and times such as ours which encourages free will and the attainment of the highest happiness yield, there are no laws against it (laws which are strictly enforced that is). Obviously there are certain biases within the court system, such as the fact that the non-cheating party will have the benefit within a court of law.
Also certain pre-marital contracts have clauses which penalize the cheating party.
But as far as a solid law that says, "No cheating on your spouse," nothing that I am aware of thus far. |

In the unitedStates a person can get by with almost anything.
You know this of course. But if you believe in what the Holy Bible says true then Adultery is a huge no no. Listen to your own reason. you are the only one who has to live with your choices. |

In the US I believe that there are a few states that still have adultery in the penal codes that would make it a criminal offense....Utah is one I believe.
In some parts of the world adultery is not only illegal it is punishable by death...for both of the participants. |

illegal???? most likely not , but the BIBLE tells us it is punishable by death. so u judge for your self. adultery is one our commandments that we are not to do. |

depends on the State that you are talking about if anything is actually on the books....about it being enforced - I have never heard (or read) about any recently (at least in the past 40-50 years) getting arrested for comitting adultery - It would be much more likely this issue would be handeled in Civil Court (action by other spouse) or Probate - Family Court (eg. a divorce action). |

There are no civil or criminal charges that go along with committing adultery. As far as the courts are concerned, adultery can only be given as a charge for the disollution of a marriage, or a provoking agent for aggravated assault and/or second degree murder.
Adultery is not a charge in and of itself. |

Not in America, pretty sure not in any civilized Western Countries.
Possibly in some third world countries, particularly in the middle east.
Every couple of months there is a story out of that part of the world were a woman (it's rarely a crime for men to do it) is stoned to death for having an affair. Even in these cases it is usually not a law on the books but an accepted practice that the government will over look.
So no I don't think there is any law where it is technically a crime. |

It is not against the law in the U.S. except for in the military. If a military soldier commits adultery, he/she can be charged with Article 134 of the UCMJ and be punished by the military. |
