I recently was wrote a citation by the police for firing a firearm withing city limits. But I believe a bb gun is not a firearm what do you think. Also I live in oregon.

No. It's a toy. But you must treat it with respect, always activate the safety and carry it only when traveling to and from an airsoft game. If you act like a dumbass and wave it around in public the cops will arrest you or even blow your head off as it looks like the real thing. |

What you believe has little bearing on what is a citeable offense in your town. If the law there classifies your toy as a firearm when you discharge it illegally it really doesn't matter that it doesn't rely on gun powder to function. |

I would judge that around whether it could actually hurt someone, which I'm sure was the original intent of the law. If it was on your own property, and you were firing into a backdrop or similar target, it could be argued that you weren't endangering anyone. But if it was a public park or open area, that would be considered dangerous. A bow and arrow (the target kind, not the hunting kind) is not a firearm, but I would expect to get a ticket if I shot it in a public park. |

There is no "fire" involved in the propulsion of the projectile out of the gun, so technically it is not a "firearm." The propellant is compressed gas. Maybe you could argue that in court and have the case dismissed. |

If the officer felt that you were using your bb gun in a unsafe/dangerous manner within the limits they can cite you for it.
A bb gun is not a firearm, but can cause a person harm or death & could be considered as a weapon by law enforcement. Check your law in Oregon. |
