Is a contract valid if a 13 year old signs it?
|
we have adopted a dog through a charity that knew where some one was give them away. the dog was 8 week at the time it is now 13 weeks. there was a contract to sign which my 13 year old brother signed. one of the conditions was that we had to castrate the dog at the age of 6 months. what can the charity (animal crakers) do if we dont want to castrate the puppy?... is there a posibility that they can take the dog away.i'm 18 years old but i did'nt sign anything no adult signed any document.

13 yr olds cannot sign contracts. Which means that it is void. That also means that they can come take the dog back. I can't imagine that they actually let a 13 yr old sign a contract for adoption. |

No the contract is not enforceable. However, that means that they can take the dog back if you don't comply. They can't sue for damages if he breaches the contract, but either party can cancel the whole thing and take the dog back. |

Firstly, rendering your dog unable to procreate is an extremely humane thing to do. With the massive quantity of dogs without homes, taking away their ability to have children is a very good thing to do.
Nonetheless, no, a contract must be signed by someone above the age of 18. You still should follow it though. |

No it wont be legally binding as he is a minor.
Why do you not want to have it done though?
I think seen as you got it from a shelter, that breeding from him is a bad idea as you have no history of the dog. |

I don't know where you live, but in the USA a contract signed by a minor is null and void. I am surprised that anyone in their right mind would let a minor be the sole signer of any contract. |

It would invalidate the contract, BUT that would mean you have no right to the dog as well. Think about it. They gave you the dog and you signed the contract as a condition to taking it. If you don't follow the contract and it isn't valid they could just as easily argue in Court that it is still their dog by rights of you giving them an invalid contract that was part of the transfer. They aren't trying to be mean about getting the dog castrated, they are trying to keep the dog from leaving puppies all over and creating more stray dogs. Why wouldn't you get it castrated? I mean I could see if it was a pure breed with papers(which a charity wouldn't have in all likelyhood) but a mutt that you got through a charity should be castrated. |

not valid but if you were there you have an oral agreement. Lets not teach the 13 year old that being a liar is OK, you I think may be lost already. |

when you adopt a dog it is still property of the charity who you adopted it off so yes i think they could take the dog away but you have to be a pretty heartless charity to take an animal away from a loving home just because you don't want to castrate it( i think they only do make you do because they don't want you to use the puppy for breeding so you can sell puppy's ) |

Take the dog and run to Mexico.
Lol. Not really. Although those were the conditions in the contract, a 13 year-old signed it. This contract might be void because the person whom of which signed it, is 13. There could be, different conditions based on your state/country of residence. |
