a legal agreement if there not a signed document made, this is with a phone company and the items have not as yet been opened and the party wish to return them, and have changed their mind, no money has come into this agreement yet, at the time of the phone call the accepting party did not totally understand.

It is possible to obligate yourself to an agreement over the phone. This is how it is possible to purchase things or pay bills using the phone. Often times, companies will record their calls to keep a record of any agreements that are reached or statements that are made.
If you purchased something and received it in the mail, sometimes you can return it unopened for a full refund. Sometimes they will charge you a 'restocking' fee and/or shipping and handling charges.
It really comes down to the specifics in your case. Whether the company you did business with will try and hold you to some obligation or not depends on things like the internal policies of that company, the laws that prevail in your state (country), the type of agreement or 'contract' that you entered into...in other words, so many variables that it isn't likely you can get a worthwhile legal answer here without far more specific details. |

In English Law, a contract (unless a Deed) must comprise an OFFER, ACCEPTANCE and VALUABLE CONSIDERATION. Such a contract can be written or verbal.
If any of these 3 elements are not present, the contract is not valid. In addition, if some essential condition has been misunderstood, the contract is not valid.
In addition, there are rules about phone selling and prospective house calls, that allow a person to change their mind within a specified period. |
