Is against any human rights for someone at work to keep a diary on me?

my workshop controller is keeping a diary on me, and i want to know if anybody knows if he is allowed to do this? it is kind of off putting that he marks down every time i go to the toilet, how long i'm taking on jobs, when i have my breaks. etc

please help

i have not been given any verbal or written warnings, i have had a disagreement with the person keeping the diary, but the other thing is, i have found out about the diary by accident, they are trying to keep it from me, i have not given them any reason to keep it, i am on time every day, never been off sick and do not use the toilet often.

You need to talk to your HR dept about this.

no it's not against your human rights but you are entitled to know what information is kept about you under data protection laws so put in a claim to your boss to have a copy of all details that are recorded about you or if you don't trust them then speak to their manager.

P.S they can legally charge you a small fee for doing so but it shouldn't be more than few £'s at most.

Why not? It's just their way of recording:

- How often you slack off.
- How well you are progressing. (IE. What may have taken you 1.5 hrs to do it now takes 45 mins.)
- Any improvements being needed.
- recommendations for advancement.

i think it depends on the amount of detail. many jobs keep track of exactly how much time is spent actively working. if you feel uncomfortable and that there is too much detail raise it as an issue.

ae they doing it to anyone else? if it's just you, its definately issue you have to resolve.

You need to ask yourself why he feels the need to do this.
What if he uses the information he gathers to prove to his boss that you are the hardest working employee in the firm.
It could be that he is about to recommend you for a promotion.
No?
No I dont think so either, so could it be that you need to pull your socks up?

Nope, a lot of people make their employees keep their own journal. Just because they dont trust you to make your own doesn't mean its a breach.

Sounds like you've either been slacking or someone thinks you have, or possibly they're just doing a bit of a survey of the "average" worker.

Why don't you ask why he's keeping it, and see if you can sort something out before its too late.

No, this is perfectly legal and a very common way for a boss to prove an employee isnt working as they should.
Your best bet is not to give him any ammunition and also keep your own diary If you go for a toilet break write it down, write down the amount of time spent and have a non-friend colleague sign to confirm, this way your boss cant exaggerate.Be careful, it sounds like he is out to get you.

No it's not against your Human Rights. An employer can keep a log on your behaviour and work rate. It sounds to me as if they are going to get rid of you and are going to use this as evidence if you attempt to take them to an Industrial Tribunal. Sorry, I hope I am wrong. Good luck.

It depends upon the context of WHY he is doing this and you have pointedly neglected to say so, but in theory then yes he is perfectly entitled to do this - especially if you have also been given a verbal or written warning regarding your behaviour.

You are an employee, they have every right to monitor what you're doing at work. You may not be the only one or he may have a reason to be monitoring you. Either way, maybe try to discuss it with him or HR and see where you can improve to make sure you're performing to standards. Make sure it is documented in your HR file and make the effort to comply with it. Good luck to you.

Not illegal - but you may wish to go and see you HR dept and you do have a legal right to raise a grievance if you think his actions are unjustified.

Unfortunately, they can. Problems may arise if you are the only one they are keeping a diary on. Does he keep diaries on your coworkers? If not, there are 2 things.
1 - it may be in violation of your human rights, especially if you are considered to be in a protected class (women, over 40, non-white, or disabled)
2 - you may want to evaluate your initiative towards your work, do you seem to take more or longer breaks than you should, or than your coworkers in similar positions? If not are you completing all (or most) of your work on time and without asking for OT. If you fall into case 2 they are looking to get you out. This has nothing to do with your human rights or whatever protected you may or may not belong to.

It represents bullying and harrassment in any reasonable sense. While employers are entitled to monitor workers for the purposes of the work, they must not do so in any way that undermines their rights to privacy and dignity.

You should also look to see if other workers are being treated in the same way. Check your employers procedures especially their bully and harassment one.

No, it sounds kinda like he's breaching the right to privacy, but he's not really, i mean, he lets you go to the toilet and that... i suppose it would be quite annoying but no... he's not... sorry

It could be considered harassment which is illegal. You can keep a diary of incidents that constitute harassment or ill treatment and take it to a tribunal if you've worked there for more than 12 months.
