I live at this apartment and they sent out a promotion at the beginning of the lease term saying "1 month FREE rent if you sign your lease before 04/11/08" and seeing that, i did. Now, 2 months left on the lease, i'm trying to claim this and the manager said, yes i get a free months rent as long as i wasn't late on any payments.
I think i turned rent in one day late on one of the early months so i guess that makes me ineligible. But the thing is, that was not on the email. It just says free months rent if i sign my lease before the date, it didn't say anthing about a single late payment making you ineligible. Should i still be entitled to my free month since the email didn't specify?

Yes an email is a legal document. There are laws that have been passed recently that say emails are now seen as legal written documents, the same as a fax is a legal document. If it does not state in the email about being late on payments he will have to honor their promotion. Tell him you are going to take him to court and show him the email that says nothing about late rent and he may give in. Good luck!
Sorry Judith. You are wrong. A late payment has nothing to do with it if that is not mentioned as one of the eligibility requirments for the promotion. The only other way the landlord would be right is if the lease says that "during the term of your lease we run any promotion you would be ineligble for promotions if your rent is late." Or if the email said please see management for further details and eligibility requirements and they have in writing that you can't be late on any rent payments. |

I think so; tell him you will take him to court. Take him to small claims; you have a very good chance to win your case. You acted on the offer by signing the lease; he must now give you one month's rent free. A day late should not entitle him to forfeit the one month's free rent; he can always charge a standard late fee for that. Do not let him get away with it. |
