We are in California. My husbands job just sent out a memo referencing certain pages in the employee handbook. Yet on other issues that are beneficial to my husband they ignore. Can we hold the handbook against them?

You do not have a right to a job, unless you have a contract specifying you have a right to a job. The contract can be through a Union or Personal. Without the contract they can change rules, ignore rules or fire you for any reason they want except the ones specifically prohibited by statute.
So no, the Hand Book means nothing without a contract. It is generally used a means of making things run smoothly for management. It is not a means of making things easier for employees. Having the company run smoothly and make a profit is the primary goal of management. If your husband does not make the company run smoothly, they can replace him and there isn't anything you can do without a contract. |

How would you hold a handbook against the company? If there is something in the handbook in which the company is not providing that is promised, then your husband should follow the proper steps spelled out in the handbook to report it to the proper parties. If you are just looking for something to hold over the company, you could be helping your husband find another job. In today's society, you should be happy he has a job. |

It provides lots of information that is designed to give your employer leverage against you.
It will help you to know it like the back of your hand. There are employees in any organization who will try to "get ahead" by knocking you back.
These swell individuals will try to rat you out, and get you in trouble. If you know the handbook, you can avoid some of the "technicalities" that might be used against you.
Also, knowing the handbook will give you some ammo of your own, if the fur starts flying (you can turn the tables, and point out where the swell person is ALSO violating company policy).
If at all possible, you should soak up every bit of info the company has regarding
the company-employee relationship. |
