Is he legally charging me or is he swindling money from me?

Ok so today some guy from whirlpool came to do a diagnostic on my fridge and is charging us $124. He didn't fix anything, he just told us to move our food products from the cooling vent and that's it. Even if we don't have insurance or warranty if he didn't fix anything I don't think i should pay. So any answers about if he was just swindling us or is it just to pay.

This is the old story about the man who took his car to the garage to get it fixed. The mechanic took one look; hit it in the appreciated spot, which fixed the problem. He then demanded payment from the man who remonstrated, "All you did was to hit it with a hammer!"
"Yes", replied the mechanic, "but I had to have the knowledge to know where to hit it!"

Your fridge was not functioning before the guy came, now it is.
Fair do, you have to pay him for his experience, training, knowledge and the fact he had to travel in his time to your abode.
$124 seems a little steep, but I expect there is a minimum callout fee to attend.
Again be fair, it didn't work before he came, now it does, job done as you asked.

Perfectly legal. A lot of companies now charge you for finding out what's wrong with a car, or appliances.

No different from going to the ER because you think you are having a heart attack and it is only indigestion. You will still be charged. You have asked in advance.

If you called them to fix a refrigerator that was not cooling, and it is now, you owe them for a service call, no matter how he fixed it.

Some companies charge for diagnostics and some don't. I don't know about Whirlpool. They definitely have the right to charge you for coming out. You should have asked when you made the appointment.

thats the way life works! you're paying $124 for hist time, even if he didn't physically fix anything.

You do not have to pay what you did not agree to pay. There is, however, a presumption that you will reasonably compensate a professional for providing advice. If you think $124 is too much for the advice you received, don't pay, let them try to sue you and prove that it is reasonable. If everybody else in your area charges the same price for a non-repair service call, you're probably going to lose and end up having to pay attorney and court costs on top of the service charges.

for about 6 years i have been paying out yearly for insurance for my fridge/freezer. Over the past 3/4 years i have been calling them out them for the same respire work. i got fed up, as i feel they should replace this item. they feel this item is not fit for replacement. My last call out was in April. My renewal date was in Jan/Feb 2011. I am being threatened with paying the call out and labour charges for this recent call out. I pay by Direct Debit, which i stopped. Please, what are the legal implication for me and can they demand i pay or continued the whole year's money of £117 plus.
