If the check was made out to him, it's his money to spend as he wishes. |

I'm pretty sure you can do with it as you please, most people just prefer to spend it on the funeral because it makes sense. |

It is not against the law but is most certainly morally reprehensible. |

The proceeds of an insurance policy can be used for anything the named insured wants. |

Bless you and your daughter, I am so sorry for your loss.
The funeral home will now sue him for the money. He may have spent it, but it is still a rightful bill if he signed the papers.
Also contact his CO or have the funeral home do so. What he did is strictly against military protocol and he will be forced to meet his obligations. |

the person getting the check can do what they want with it.................some some folks have no ethics.............but then, you already knew that! |

illegal, no,,lowlife yes
As long as he was named the beneficiary, i dont think there is anything illegal about it. I would think the mother could sue him to legally make him pay for half of the funeral expenses..what a shame that she would have to. I am so sorry for your loss. |

its not against the law. If she helped him pay the premium then she should try to get her half. It will cost for a private attorney |

Talk to an attorney. It could be insurance fraud, or it could be his right to do with as he pleases.
Pretty heartless, if you ask me. Your daughter is lucky to be rid of him. |

The parents have a legal obligation to pay for the funeral of their child. The insurance policy was written so that the proceeds were paid to a parent, and not to a funeral director. The father can really do anything he wants with the policy proceeds.
Usually somebody in the family must sign a contract with a funeral director agreeing to pay for the funeral. If he signed such a document, he is on the hook. That is to say, he agreed to pay the cost, and he is obligated by his contract. The funeral director can sue him.
If I were the mother of the deceased child, I would write to the commanding officer of the soldier [father of the deceased child] and explain the situation to him. When a commanding officer calls a soldier in for a discussion, things often happen quickly. |

my stomach is turning right now..
I am almost believing this question is a troll one...but I can't see anyone being so sad and sick to make this up.
First..my heart goes out to mom and you...I am so sorry for your loss.
I honestly do not know if it is against the law..unethical..yes..cold..selfish..appa... could call the insurance company to see if there were guidelines for the insurance money. Was the dad the only person on the beneficiary of the insurance?...You need to find out what all was involed in the claim..and how the dad ended up using all the money. ..if he was the only person on the claim..there is not much you can do..
but call the insurance company about the claim to see what it all entailed. |

It probably is not against the law.
My father-in-law spent his insurance on a brand new electric guitar instead of paying back the wife's parent's who loaned him the money for her burial.
I am so sorry about your grandbaby. And i'm so sorry how this is all playing out. He should pay for the funeral, but when and how would be up to him. |

in most states , if th benifishery was listed , whomever that is gets the money to do with as they wish , but, thats sad, that he doesnt spend it for the child, hopfull he will enjoy the car and pc?and think of his dead child, each and every time he is in it or on it |
|

FFS what's with the names?

EDIT: Jeanie ~ Brilliant idea. Also On, yes!!! Hopefully his Commanding Officer will have some ethics.
~*~*~*~
Tell the funeral home to send the bill to him.
Best wishes and good luck with this, what a sad situation.

Call the Army base. Ask for help. His commanding officer can make things happen.
Good Luck |

no not illegal. pay for it then try suing him in small claims |
|

no it isn't illegal and the term you used was seperated not divorced if they were married then she can sue him for her part and pay for the funeral if not then some will still have to pay it |

Well it seems that it wouldn't be against the law, but it seems that the mother would have been entitled to half of that check |

It is very unusual for a parent to have a life insurance policy on a baby. (It may have been a legitimate policy if his job has dependent's life insurance, but that is extremely rare.) I hate to say this, but please make sure there has been no foul play in the baby's death. |
