If we continue to allow the supreme court (lower case with great intent -- it's more than they deserve) and the democrats to legislate from the bench, it could easily be interpreted under a "hate crime." Is it truly illegal? No. If it were, a whole lot of "brothas would be in jail for having used it on one another. As it is, it's only offensive when a white uses it. Those who claim to be tolerant are intolerant of those who are not intolerant. Go figure.

Imagine two scenarios:

1.) You are a blogger who really hates Barack Obama. You write a post using the N word to describe him. Can you be arrested? The answer is NO, your writings are protected by the First Amendment.

2.) Your scenario: you are walking down the street and use the N word directly to a person. Can a cop arrest you for this? The answer is YES, because of one of the exceptions to the First Amendment called the "Fighting Words" doctrine.

In 1942, the US Supreme Court held in Chaplinsky v. New Hampshire that , "the lewd and obscene, the profane, the libelous, and the insulting or "fighting" words those which by their very utterance inflict injury or tend to incite an immediate breach of the peace" can be prohibited.

So to apply this test to the scenarios above, it should be obvious that there is no "immediate preach of the peace" in the first case while there very well could be one in the second case (for example, by that person reacting to your insult by physically assaulting you.)

Whilst you may have the right to freedom of speech, you also have a responsibility to consider the effect of doing so on the other person. There is a principle which is a good guide to life "do as you would be done by". In this instance, imagine the roles were reversed and how YOU would feel if a white person calle you a n*****?

If you live by that rule in all your relationships you wont go far wrong.

Being a african american woman I find that word only offensive if it is used by another race especially in a derogatory way. Noone should use it NO race not even mine but we do , it was banned by the NAACP but I dont believe it is illegal. But if you say it to the wrong person, you better have on your NIKe!
