depends. FMLA covers places that employ fifty or more people. FMLA requires doctors' statements and proof of illness/disability.
Other than that, work is at will, unless there is a contract.

If you have a doctor's certificate that you can't work, then it may very well be illegal. Talk to an attorney, they will usually do free consultations.
