i have just been advised a neighbour has been taken videos of my son who is 4 years old and autistic, this can either be full video clips or just voice recordings what is the law on both? is this illegal? is it just full videos of my child playing or is voice recordings illegal aswell?

yes it is, firstly go and advise him you want all the recordings handed over now, if he does not give them to you phone the police. There are laws to protect children for a reason. The whole lot is.
Personally I would go straight to the police as it maybe that it is going on to the computer, if the person is innocent then no harm done, if not then the dirty perv will be caught sooner rather than later. |

It may not be specifically illegal, but you do have options. Call the police and file a report, you have that right whether a crime has been committed or not. They can also advice as to the illegality of your neighbor's actions. Speak to a lawyer about a civil action against your neighbor, your family's privacy has been violated.
Don't confront your neighbor, let the authorities handle it. |

I would call police explain situation and as them to speak to the neighbor. I feel it's just short of stalking. Unless he had your permission I don't see any reason for him to be taking or recording anything about your child. How well do you know this person? |

If they were taken out in public, probably not. I would consider seeking a restraining order. |

I would certainly ask him if it was true, and what he plans to do with the recordings. I think I would also be advising him to stay away from your child or you will ask for a restraining order. |

It is not illegal to video or record anyone. It only becomes an issue if someone tries to use those recordings in Criminal or Civil proceedings.
The prosecution can not use them unless legal warning is made prior to the taping but the defence can use anything they like in their defence. |
