depends on what you mean by your back garden.
do you own the house,
you can apply for permission if you do.
if the person is now ashes then no you can bury them in your garden.
if the house is yours it is a legal matter because you may want to move the new owner may not want a dead body in the garden so you have to make it part of the house deeds

You will have to get permission from your local council and declare it on the deeds of the house in case you ever sell. |

Seriously, it is not a good idea. When the house comes up for sale you have to declare the grave. The prospective purchaser will undoubtedly be put off. You will be put to a lot of time and trouble obtaining an Exhumation Order. |

I think this depends on where you live. In NYC you can't legally even bury an animal in your yard. But I think in most rural areas , it would be perfectly legal |

Pretty sure it is. It's touch and go with animals (can't bury them less than 4ft down and no where near running water).
Speading ashes should be fine though |

No. They must have a legally recognised funeral, and you must hold the freehold to the land. (English law) |

Well you can't bury your pets in your backyard so I'm guessing you can't bury people either... (In Miami-Dade, Florida) |

Hi there.
It is totally legal, but you do have to declare it to the council for health and safety reasons - there are minimum burial depths involved and also the question of affecting the water table. Stick to cremation, less hassle.

It would be nice if you could keep a loved one close and tend the grave yourself and know that no one can desecrate the grave.
However its not legal in the UK because bodies pollute land. There are very strict rules on cemeteries because of this. |

By the way, I once had a boss in Africa who was buried in his back garden. It's quite common there. |

I don't know really. You may have to have a special license. It would also depend on the size of your "garden". I know one of our near neighbours has his family buried in the garden, but he has acres. (South UK) |
