I live in NY, Brooklyn to be exact. I am 23 years old but I was wondering if I actually sat on my steps outside my apartment door, can the police come by and give me a ticket for public intoxication?

Ya, dude. Unless u are intoxicated, they cannot give u a ticket. On the other hand, if u did get a ticket, there is no way u can prove that you were not intoxicated at the time of ticket reciept. What you can do, however, is get at least three other people to chill with you so that if you are ticketed again, you have three witnesses to prove your innocence, including you. |

I think it depends on the laws of the state. I know in my state I can drink on my property, but not in the street. Since its an apartment, it may change the laws also. |

If you are on premises, they can't really take any legal action. But be cafeful, because the USA Police can take any cause of action, and it is pefectly allowed (legal) in the country to carry guns, which is strictly prohibited in the UK, where I live.
You should drink either in the house, or possibly the garden, but I wouldn't risk walking off site in any way.
