i live in the uk. im going out on saturday night and its in leeds, which is a good hour from my house.
i have a nice sized 4x4 with enough space to sleep in if i fold away all the rear seats so i might jsut kip in that instead of getting a taxi all the way home.
is it legal to sleep in the back of my own car while drunk??? i doubt ill be caught, but i just wanna be sure cos id be so mad if i lost my license or was arrested or something

A mate of mine got done for it after he had lost his house keys and then went out for a drink, ( on foot) when he got home he still was waiting for his son to arrive home so he could get in. He then got into the back of his car after hiding his keys on top of a wheel. A policeman came along and after a search found the keys so he was successfully prosecuted. Makes you wonder doesnt it. IT seems unfair to me |

If you've got the keys in your pocket, then you could technically get done for being Drunk in Charge. |

The previous answerers who have warned you of the perils of being found drunk in your car with the keys about your person (and any interested police officer will search you and the car, including the glove compartment) are correct. Moreover, if you're going to be that drunk, the chances are that you'll still be drunk the following morning, when people will be out and about and you will want to be on your way. People have appeared in court for being above the statutory limit when driving to work the morning after the night before. |

It's illegal to be in charge of the KEYS of a vehicle while drunk, let alone have it turned on.. so i'd guess it would be, yeah, as you're going to have the keys on you.
I'd risk it though, personally! |

If caught, you potentially commit the offence of being drunk in charge of a motor vehicle.
The main angle of defence is that you had no intention of driving the car. Sometimes an uphill battle in court and really do you need the stress and hassle of a case going to court.
Why not book a room at a Travelodge or Premier Inn. It will be cheaper than a taxi and you can get drunk out of your brains without a care in the world. |

Yes as it is an offence to be in charge of a vehicle while unfit to drive. Anyway although you say now that you would just kip in the back of the car when you have had a few your judgement may be off and you may, like an idiot, decide that you are OK to drive. Best not to take the risk. A cheap B&B is preferable to getting a fine or worse - you could end up killing someone and then you would never forgive yourself. |

The only way to be 100% sure is to give the landlord / barman your keys. If they are not in ht evehicle with you they cannot touch you. If you have the keys then technically you are in charge of the vehicle. Daft it may be but that's the law. |

It depends on the state, but the majority of them say that if the keys are within reasonable reach that it is a DUI, or public drunkenness if your doors are unlocked. |

You can be charged with being drunk in a car even if you aren't driving. Certainly having the keys means you are in possession of the vehicle and subject to any road traffic laws. The only way round it would be to park in a lay-by (risky) or a car park in a service station (expensive) or on private land (one of your mates' driveways). |

Not at all,depending on where you park! Worst case scenario would be a cop waking you up telling you to get out of car,then ultimately giving you a drunk in public charge. Do not, I repeat do not leave car keys in the ignition.That is a defenite DUI charge. I know from experience. |

as far as i know its not, as long as you leave your keys with the bar man .just make sure youve got a warm blanket and no keys on you. and do'nt park on a hill. |
