I believe that CA has a law that prohibits smoking in a vehicle when minors are riding in the vehicle. Or at least they're trying to push such a law through. There is no law that prevents someone from smoking in the privacy of their own home, whether there are children in the home or not.

There is no law stating that a parent or anyone for that matter cannot smoke around children. I hear it's a stressful situation and it's your girlfriends parents but you will just have to be upfront with them. Just tell them either you don't smoke around our kids and respect our decision or you won't be able to be around them.

In my country it is illegal... actually you can't smoke 10 mts near to a school... even tough this is an open place... greeting from Colombia.

no...there is no law...however secondhand smoke is VERY VERY bad..so i recommend you not smoke around them too much

It's your car and your family. Be a man and not a mouse. Since she already backs you on this and has told her parents, give them the following warning. When they stoke up, pull over to the side, roll down all the windows, and tell them they're going noplace without chucking the butts first. If they front you and sit there smoking, inform them that they can call a cab to get back home, that their juvenile behavior sets a bad example for their grandchild and they have just lost the privilege of riding in your car. If your girlfriend turns chicken on you, tell them that the car won't move until they turn over their cigarettes to you first. Surprise your girlfriend with this and I'll bet you get instant admiration.

I'm a smoker of 46 years, bit will not smoke around those who don't, especially in my lady's car or home. People ask me at parties if I'd like to step outside, but i tell them that I don't feel the urge because social consideration is stronger. I'm down to 2 cigarettes a day, from a pack.

In my state (Arkansas), it is illegal to smoke in a car if there is a passenger younger than 12, but nothing in regard to smoking in a house with children. I have heard some states have laws in the works of trying to make it illegal to smoke in a house with young children, but I don't know how true it is or if anything like that has passed. Personally, I don't think people SHOULD smoke in a house with young children around, but I'm guessing this is your girlfriend's PARENTS' house and not hers. If that's the case, she doesn't really have a right to decide what they can or can't do there. All she has a right to decide is what she will or won't let her children be exposed to, so if she doesn't like their smoking around her kids, she should remove her kids from the house. Even if there was a law like that, they are her children not theirs and it is their home, so they would be entitled to expect her to remove the kids, rather than for her to be able to insist they not smoke.
