Yeah, you can't really use verbal provocation as a defense. You could sharpen your verbal skills though, and embarrass them... expose them as pitifully ignorant. That's just as good or better (no chance of injury to yourself).
You might be able to call the cops, especially if it's in a public place like a store... but if it's any kind of context like a school or business, just document this somehow and you can get them in massive trouble. Companies or schools just won't tolerate it; they can't. They're afraid.

We do not escalate an already dangerous situation into violence. When a person is ignorant, violence will not change them.
Words hurt, huh? Fight back with the same weapon.
It is tempting to 'talk down' by using physical force, but you lose as soon as you lose your temper.
Fight back with intellect instead.
Doubtful you'll change a closed mind, but it may plant a seed.
My boyfriend kicked the poop out of a fellow for being racist against me and while he said he felt better immediatly, I wound up losing my office..my place of business. We also went through the proper channels and the Human Rights Commission where I live did not find him guilty of anything. Either way, we lost.
If this person verbally assaulted you and they work with you...or you work for them, you have a case with your state's human rights commission and I wish you better luck than I had.
That's the only experience I have had. I always lose when I react quickly. I also seem to lose when I take my time.
So I go along my way sowing seeds of change in minds of hate...trying not to look at them too closely, lest their sickness invade....

there is never a reason to strike anyone, unless in self-defense. don't call the cops, they'll laugh at you, just distance yourself from this person and realize that although they can make you angry, they are just words. why give that person the satisfaction of seeing they got to you? |

B. insight a riot.
C. to say something in a public place that is likely to cause a violent reaction,.

It's never legal to hit someone. And is really unnecessary, I mean really what do you accomplish in hitting the dude, do you think he'll stop saying those things because you punched him? No you're using at as an outlet for your annoyance, anger and repulsion and only sinking to his level, so by hitting him you proved your no better and no more mature then the ignorant idiot spouting off racist comments. |

I would say it is illegal to strike someone for racist comments. Even if you turned them into to cops there is really nothing they could do unless it becomes a consistent problem. Then it would be a form of harassment I believe. Then you could put a restraining order on them. You could report it so that way if it becomes on ongoing problem they will have it on record. |
