Is it legal for collectors/banks to call your workplace..?

Recently, a collector (National City) has been calling and harassing the house while my mother is at work.. They called 6 times in a day.. and I repeatedly told them that she was at work! They are trying to collect on something that isn't even late until the 27th!

Later when My mother got home she informed me that they had called her at work and she refused to talk to them because it is legal for them to call her at work.. I did not give them her work number and she says she has never given it to them. They didn't have her office number but the number to her department so they must have called the switch board to get it. (She works at a hospital) When she asked how they had gotten her number they refused to tell her.

The next day they called again.. 3 times, but when I answered I had gotten and operator telling me to hold until someone is able to take my call.. I waited on the line 10 minutes each, hung up, then they called directly back seconds later.. once again, I was listening to an operator for minutes then finally a lady picked up.. I told her she wasn't home.. the lady asked if she was at work.. and I proceeded to tell her that she had no business knowing where she was and that it was legal to call her during working hours because she could be fired for it.. The woman apologized, said she would remove her work number from the contacts and would call back when she was off work.

Is this legal.. harassment?

Depending on the state where you live, debt collectors can not call you at your place of employment . That is the law. While they may call you at home, the hours are specified and are usually between 8 or 9 am and 9 pm at night. They have to identify themselves,can not use abusive language, threaten the person with jail, and must never harass them. The next time they call, simply tell them to tell you who they are and the reason for their call and you would pass the message on to your mother when she returns. Never give them any information and if they insist, tell them that you are a minor and let your mother deal with it.

I am in charge of a small company... I just let the collector know that I would be happy to give the employee the message but, if they call anymore the employee will be terminated due to our handbook states, no personal calls.
That usually works.
If they call again, I ask for a manager and then I am not nice and let them know if they call again I will not be so nice.

She needs to tell them not to call her anymore - they are legally required to stop.

Also, if they continue after she has requested that they stop - she can sue for each occurence.

no there are laws concerning collections and in the recent years the have been breached. i would take this to the states attorneys generals office

it is legal for them to call you at work but most collectors would rather catch you at home because people just tell whoever answers the phone that they are busy

of course if you tell them to stop harassing you that means repeated phone calls then they must stop or you can sue them
