In today's society, yes. Law enforcement and our justice system seems to have a license to do just about what they want, as long as they can get away with it.
The American people don't realize there civil rights are being violated and taken away at an alarming rate. When the public petitions lawmakers to deny smaller groups of people there rights it makes it easier and easier for them to take away other people's rights.
I believe if the minor is being questioned in connection with a crime, which was most likely the case, then again the answer is "yes". Otherwise why else would they question her. Your best bet is to check with an attorney |

that doesn't sound right, I would be in someone's face down at the school and the police department until I got some answers |

I think if there is reasonable dout they may have the authority to do, my son was search at school but he had marijuana on Hi's car at school property, the only difference on my case they did call me the same day. |

No...doesn`t sound legal to me...why dont you go and talk to them about this? |

No they can question her all they want, it is up to the school to inform the police of the nature of the questioning. If your daughter did not want to answer the questions all she had to do was refuse to answer the questions, and ask for her parent to be called.
If I was her I would have asked for a lawyer, and as soon as they said she was not under arrest, I would have said good and walked out. They can't legally detain you unless you are under arrest. |

Hey man i'm split here
If your daughter did something bad, consent out the window
if she was falsly accused go get a lawyer, and a bank account, cause your already rich :)
and the child belongs to the parents, kinda gods rule lol |

No. |

It is legal. until 18, a child belongs to the state before their parents. thats how the state can remove your child from the home. |
|

Angel
 |
Yeah that's legal. Even though the parent doesn't feel like it's right that the police are doing things without your concent they're allowed. I know this for a fact because it happened to me. Cops can make deals with your daughter without your consent and you wouldn't even have to know about it. |
|

A_WWE_FAN_4LYFE

Hell no, that's not legal. |

Parents should be contacted. Detained? Something needs to be done. That would be considered illegal. |
|

Doesn't sound illegal to me.
Must have been something fairly serious.
You omitted that bit of info.
Is this the "my child would never get involved in something like that."?
And then you find out kid is into it up to eyeballs. |

If the police believe a crime has been committed, or one is eminent, they can question the juvenile without parental permission in the interest of expediency or emergency. |
|

no cause when you send your kids to public school the school has a quasi-gaurdienship over the child therefore if they asked the school for permission then it's ok.
Plus if you kid didn't do anything wrong why are you worried about the police asking her questions?? People like you pi** me off cause you do unlawfull stuff and then try to justify it by saying the police injured your rights!
I hope your kid goes to juvie!!!!!! |

It's done every day . With this government , it'll get worst . |

no
if not under arrest
she can be held and question
if she refuses her right
most of the time you'll be arested |
|

WEEEDMAN420
|
No i would seriously do something about it especially if they didnt notify you before |
|

Ya-sai
 |
Not legal to do that without an adult consent. You need to speak to the school and find out who gave consent and take the matter from there. |
|

sharon B
|
it is against the law not unless there was a adult present could be a teacher but they were not allowed to ask questions with out some ones present

why would the police need their parents consent? no that's bad, sorry. i dunno the law but i'm sure they followed it. you could look it up - is it US or UK? |
|

they should of tried to contact you every way possible, if they cant reach you they are still able to question the person. The minor could ask for a lawyer, and not answer anything but her name and address. |
|

big&rich
 |
that is totally illegal. Anyone under the age of 18 can not be questioned by any member of law enforcement with a parent or guardian being present or getting your concent over the phone |

Sounds like a lawsuit to me. |

sounds like they should have called you, however if they are on school property i THINK that they may have the right to do that without your consent. not sure tho. consult a lawyer!! |
