My friend has a picture of herself with a gun that looks real, its not, but it looks real. I don't want her in trouble so i want to know if I should inform her. We live in Michigan if that makes a difference.

I know you can definitely get in trouble for it.
I know a parent who went to jail after his son posted pictures on his Myspace profile of him brandishing his dad's automatic rifle and pointing it at a his friend. (He pointed the gun at the camera for a pose and it was considered the same thing as pointing a weapon at his friend who is a teen also.) I think he went to jail for wreckless endangerment and unlawful weapon charges since automatic weapons are apparently not that legal in Florida.
Also, you can go to jail if the weapon is not registered. Most of the teens that get in trouble for posting pics of themselves with guns on Myspace get into serious trouble because these very same kids are already out on probabtion or something.
Remember, if you have been convicted of a felony, a violent crime, or domestic violence - you are not allowed to own a gun.
If you do pose with a real gun just make sure you are the registered owner, you are an adult and not a teen, you have not been convicted of a felony, you have no outstanding warrants, the type of gun is legal in your state, and you are not committing a crime using the weapon in the pictures.
The cops can get a warrant on you eitherwise and arrest you. So it may be legal to post, but it can still get you into some legal "hot water" some other way. |

yes, its perfectly legal to pose for pics with guns. . . real or fake. Not breaking any laws at all. its no different (legally) than posing for pics with a book in your hand. |

It may not be illegal, but it is criminally stupid. You might tell your friend that the police take note of postings like that. If a friend of hers commits a crime, where do you think they might believe the friend got a weapon?
It's most likely also a violation of MySpace terms of service. Your friend needs to grow up and smarten up. Who is she trying to impress with something like that? Worse yet, what kind of person do you think MIGHT be impressed with that and think she is the kind of girl that's OK with guns?
*Edit: Just to be clear, I'm not talking about posing with your hunting rifle or target pistol if those are your hobbies. I'm talking about posing as a criminal or "gansta" or in a way that appears to be threatening yourself or someone else.* |
