Is it absolutely illegal? No.
However you have two issues here. Reasonable force and bystanders.
If you are in a bar or club there are MANY other people around. If you needed help you could have screamed, run to the bathroom, run to the bar and asked the bar tender for help, etc. It was not as if you were alone with the person attacking you. Using pepper spray could be considered using an unreasonable amount of force in that situation.
Second, in a small enclosed space like a bar or club, pepper spray does not just hit the person you shoot at. Spray can miss, bounce off or be rubbed off. You would be responsible for anyone else you cause harm to in using it. For example, if an asthmatic had an asthma attack as a result of your actions, his family could sue you as you did not use a reasonable amount of force.
I would use a hand held TASER instead of pepper spray as that only zaps the person causing the problem. It is quiet and you can zap him and then walk away. |

Even if it is, and you used it and hit someone else...very easy to do with pepper spray, the lawsuit would be worse than the jail time. |

But always take whatever actions you have to take to defend yourself even if you are not sure if it is legal or not. Worry about your safety first.
If you are defending yourself I doubt any Tennessee jury would convict you of anything regardless of what you do. |
