Is it possible for an employee to get fired while out of work due to illness?

I wanted to know if anyone out there knows about employment and what to do if a person was employed with a private own company for about a year but recently was out of work due to a health condition and not being able to go back to work because of illness. Is it possible for the employer to lay off or fire that employee to avoid any type of legal matter? Need help!

How does this apply to someone who resides in Hawaii and currently in the process of collecting TDI (Temporary Disability Insurance)?

If still under FMLA no. However if the firing is based on some other issue nonrelated to illness (like theft for example) then the firing is legal. You have not really gave us enough to accurately reply.

It's a state employment question.

If you got hurt at work they can't fire you (most places) but if you are just ill they can drop you like a hot potato.
