Is it right to give a guy a DUI for driving a lawn mover drunk?

Someone was ticketed (DUI) and fined for that! Also,got His lawn mower taken away!

If he was on the road, yes. I once watched a man get scraped off the street after he pulled his riding mower into traffic. He was drunk but that did not make the poor guy who hit him feel a bit better. Better a DUI then dead.

a lawn mower operator is nowhere near the same threat as a car/truck driver. dui sentences are designed for car & truck drivers who present grave and mortal threats to other road users. many (most?) states exempt mowers, bicycles and horses from dui laws. lawnmower operators can be charged with public drunkenness, and various nuisance charges. no need to charge with dui.

I've heard of this happening! I think it's dumb. How did the cop know he was drunk? Was he drinking a beer while mowing his lawn?

You can be ticketed for being drunk on anything motorized.

But yes the police in an area can pull over anyone operating a motorized vehicle that is used on public roads or even areas and is endangering the public or himself.

First, you don't drive a lawn mower you operate it., Secondly, the establishment of DUI was and is directed at driving an automobile! Clearly, operating anything other than auto could not be, legally, come under the intent of DUI. This charge in this case will be dimissed by the court.

not only can they give you a dui but they could of taken him in for it, a car , a lawn mower, even a bike, it really dose not mater what you are driving/riding

I don't know...I guess he could be putting himself and others in danger by doing so? I don't think that's fair they took the mower. I'm not understand why the cops were even alerted or stopped to check him out, unless he was really driving it wildly.

i know a guy (bill) that was a simi truck driver and he was at his house hosting a 4th of july cook out and his son (john) had wrecked the four wheeler so the bill called the cops to come take a report because he broke someones phone box or something. now john was not drinking as he was only 17. when the cops came bill who had a beer in his hand was sitting on the 4 wheeler tring to fix one of the things that was broken on the 4 wheeler due to the accident and the cops arrested him for a dui just for sitting on it and he got his trucking license taken away

this is not new. the first case i heard of was over ten years ago. it's still not right. the person is barely more a threat to the public than a retard wacking his neighbors petunias with a golf club. some policemen, who would do such a thing, have probably wacked more petunias then the retard. basically morons on a power trip
