A- We still have the right to bear arms. The prohibition on personal weapons was overthrown a few days ago.
B- The court overthrew bush's anti-habeas corpus. So we still have that right also.
C- Freedom of Speech hasn't been impaired at all. Notice that you are in here saying these things?
D- There are none of these. Some foreign surveillance can take place if a warrant is signed within an hour.
E- That isn't in the constitution.
F- Contracts by federal law must have the consent of both parties. What do you mean by that? |

No. The constitution was overthrown by domestic political interests, but this is old news. Foreigners just watched and laughed.
A- right to bear arms has been essentially cancelled, recent decision notwithstanding. it took 30+ years to get a blatantly illegal handgun ban thrown out. virtually impossible to get a conceal carry permit in most states. laws on gun ownership are so complicated and hard to navigate that law-abiding citizens are afraid to own a gun at all because they fear (correctly) that they will somehow get in trouble for violating one of the thousands of regulations...
B- for all practical purposes, federal habeas corpus rights died decades ago about the time the rooker-feldman doctrine came into existence. habeas is now nothing but a totally gutted remedy that virtually never provides any relief to anyone, regardless of how wrongful their conviction was. my sources in the ninth circuit tell me that the petitions are not even read anymore on appeal unless the judges have already heard about the case through other channels. the first page is skimmed by law clerks, at best.
C-freedom of speech is so far down the tubes it is unbelievable. government continues to hyperregulate radio and television broadcast, "free speech zones" are now commonplace, protests are broken up by violent police officers with anti-crowd weapons merely because they are loud or racuous [that is the point!], and increasingly people's unrelated speech is used against them in criminal prosecutions.
d- warrant and probable cause requirements might as well not even exist anymore given the DUI exception, the automobile exception, the "high crime area" exception, not to mention the administrative exception...
e- constitution protects the right to travel between states. read it more closely and you'll find it.
f- completely true. increasingly, individuals are deemed to have consented to jurisdiction in far away places merely by having done something like sold a magazine to the place, travelled on the road there, etc. etc. This is beyond ridiculous and everyone knows it.
Freedom in america has been on a serious decline ever since the 40's, with a short bright spot during the late 50's-early 70's. We now have more laws, more taxes, more people in jail, more regulations, and more governmental intrusion into the lives of citizens than at any time in history. |

A. The recent Supreme Court decision clearly upheld the individual right to bear arms.
B. While there has been some question about the right of habeas corpus for Guantanamo prisoners, habeas corpus seems to be safe at this time.
C. The First Amendment appears to be safe if one looks at recent Supreme Court decisions.
D. Recent Congressional action (Patriot Act) may have eroded the concept of warrantless searches somewhat.
E. I know of no Constitutional or god-given right to travel without a driver's license but, of course, valid government- issued identification is required for airline travel.
F. Do not understand this contract issue. |

What foreign political interest are you referring to.
Ok the Bush Administration has tried to do B and D, but that's not a foreign political interest that is good old American style ultra-conservatism and the courts have pretty much rejected those efforts.
The Supreme Court has recently upheld A & B. There have always been some exceptions to Freedom of Speech and the Warrant Requirement. The Supreme Court rulings on them are essentially the same as they were 20 years ago.
You still have the right to travel without a driver's license, you just can't drive a car without one. For boarding planes, boats, and trains, you do need an official ID card but that does not prevent you from exercising the right to travel.
You do have the right to refuse to enter into contracts. But the person on the other side of the contract has the right to offer take it or leave it terms. If you don't want to be bound by those hidden terms, read the contract first. If you don't read it, don't gripe about what's in it. |

but I think Bill Clinton did a fine job at ratifying the constitution to allow torture of others, and Bush and his adminstration are doing a fine job of attacking/violating our civil linerties with the patriot act,also the fourth circuit court upheld Bush's right to detain Americans indefinately, without being charged of a crime, based on an allegation of being affiliated with terrorists- sounds pritty fascist to me |

I'm not neccessarily sure it is being overthrown by foreigners.Although the make up of the people who wrote the constitution is entirely different than the people charged with upholding the constitution in this day and age. I think people get elected by angry constituents who want revenge and they elect officials who will deliver that for them.And so the constitution is being ignored so that wrongs felt by certain groups appear to be righted. As long as the supreme court feels as if they make laws and not the elected officials we will continue to move further away from the constitution. Eventually, or hopefully like minded people will move to certain states and become the majority within that state and sooner or later states will take back their rights under the constitution or else the people of those states will revolt. The Constitution gives the federal government very limited powers. It gives the individual states infinite rights. We have not been infiltrated by foreigners....we have been infiltrated by idiots. |
