Is my landlady abusing me? Is this even legal? sorry so long?

I'm a 26 year old American female living in Guadalajara, Mexico. I love the zone I live in, and my 2 BR apartment...except for my landlady. It is a house that is broken up into apartments, and when I saw my apartment in Jan, there was no one living in it....the landlady was living in another apartment within the house. When I arrived in March, she informed me that we would be "sharing" the apartment, because she had rented hers to another couple....and afterall...my apartment is meant for 2 people (she said). I was under the impression that I would have my OWN place, but it hasn't been that way. I feel like I am confined to my room...it's the only place I have privacy!
OK...in the beginning she told me I had the right to have people over to visit or whatever...I thought, "Duh...I am paying rent here so I can have whoever I want in the apartment, right?" Well, apparently not. The couple who lives in the other apartment have become really good friends of mine (they cook in my kitchen because the landlady hasn't gotten them a stove yet, even though she promised to do so in Feb). The other night, I had a friend come over to hang out for an hour, tops. We hung out in my room, because it's the only place that I feel is MINE and my landlady was in the apartment and my neighbors were cooking in the kitchen. I saw the landylady talking to my neighbor-girl that night and it looked like they were discussing something serious. The next day, the neighbor tells me that my landlady was concerned about me having this guy over....that is wasn't right for me to bring a guy over, and be in MY ROOM....because who knows what kind of people I could bring over and what they could do. (My landlady's family lives downstairs and she used the excuse that she's "protecting her family and her property) Finally, she told the neighbor that if I wanted to have men over, that she needs to see some "documentation" or something from them, and we may need to discuss raising my rent because there is more than one person in my room (if I had someone stay all night).
I am dumbfounded...I find this completely ridiculous! I feel I should have the right to have guests...ALL NIGHT if I want...and it's none of her business! However, this lady is a 2 faced shark who only wants to get more money from me and I know that. She asked the neighbor-girl to discuss this with me, that way, if I had any questions I could come to her and ask.....but I don't even know what to say! I am looking for another apartment, but I am comfortable here (aside from HER) and I love the area and my neighbors....I hate that she is ruining this for me! I wish there was something I could do.....any advice?

OK, firstly you don't say if you have a written tenancy agreement/contract. So, I'm assuming that any agreement that has been made between your landlady and yourself is strictly verbal.
If that's the case then sorry, but her behaviour, as unpleasant as it is, is entirely lawful. Of course, should you have some form of written agreement then you may have lawful recourse over some of her actions, but it would depend on your lease agreement.
Good luck finding a new place to stay, I hope things work out to your best advantage.
(I'll check for future updates to try to help advise further) |

Well, you are not in the U.S., and I don't how it works in Mexico You may just have to talk to your landlady and your neighbors to try to smooth things out. Your landlady sounds a little screwy, but I think she just wants to know that there is no danger to be feared from any of your guests, but I can only guess. Different cultures carry with them different values. I used to date a Vietnamese woman. Whenever we were out somewhere, she would always not want to physically touch in the presence of other Vietnamese people but was ok with it around other people. That was a part of how her culture operates. I guess what I'm trying to say is look into these people's cultural taboos, if you know what I mean, and see what you can do to be more accommodating to their ways. Good Luck. |

You need to make up your mind. You have to share your apartment with someone you don't want, you have to share cooking, yet you say you are 'comfortable'?
This is Mexico, tenant law is pretty well non existant. You need another apartment where you get what you pay for, or you need to decide to live with what you have. |

her behaviour is totally unlawful.in ireland we have an organisttion called threshold that deal with all disputes between landlord and tenant.if u live in uk there is bound to be a similar organisation.the problem with the courts is costs.the problem with these organistaions is resources and its takes ages to get a case heard.try and find out what organisations are available to you.calmly advise her that you are not happy with her actions and that as a tenant you have rights and are willing to enforce such rights.
however be prepared that the easiest route may be to move out. |

Why don't you just approach your neighbor and discuss it with her? If you can put her mind to rest, she won't complain and the landlady will never know.
Remember that in many cultures people are not as open to the idea of unmarried people being together as we are in the US. Keep that in mind as you discuss it with her and try to be understanding. |
