My sister and her boyfriend moved into an apartment a couple of months ago. They signed a contract saying they were both tenants. However, she never had a credit check etc, and said she was just going to live there. The landlord said they both had to sign it. Now her piece of crap boyfriend punched her in the face and is verbally abusive to her. This has been going on for a year and she stayed with him hoping he would change. She even had a police report filled out. Thank god, she finally moved out. Now her landlord says she is completely responsible for the remainder of the rent and will not work with her (Sublet or paying two months rent while he looks for a new renter). He says my sister is easier to go after because she has a regular job, he has his own business and does not claim his real income. I know she needs a lawyer but, is she responsible for the rest of the lease? Thanks.

Any signature on a lease is a legally binding contract, domestic disputes do not void that contract. It is possible, however, for her to be reimbursed by her boyfriend if she does take him to court.
I hope she does, she was smart enough to get out of a bad situation. |

Sorry but the landlord is not responsible for the abuse your sister suffered. So yes the landlord can hold her responsible for the rest of the lease as she did sign it. Your sister could then go after the boyfriend for his share of the expense. |

Not being a lawyer, an American, or familiar with tenancy law there, my guess is "yes". What is more, she is probably liable for at least half of any damage done to the apartment and for any of the appliances or furniture missing. My guess is that if her ex-bf did steal or damage something, e.g. a washing machine, then the landlord would bill her for it and say she should sue ex-bf for half the cost.
What you should find in the contract is some sort of clause relating to terminating the contract before the end of the contracted period of time.
I had written a whole lot more, but I don't know anything about American law. So on the basis that a sad truth is better than a happy lie, I would say she needs good legal advice. I think she should also apologise to the landlord for anything she said. |

No she is not responsible for the remainder of the rent. She moved out so therefore she does not have to pay the last two months of the rent. |
