There is never any justification for the Death Penalty far too many innocent people in the past have been wrongly executed!!! The worst punishment would be to keep them alive in solitary confinement!!! |

They have got to get to court first. The crown prosecution service don't bring rape trials to court unless they are convinced they can get a conviction and even then they get it wrong. I was raped and spent 8 weeks in hospital and it never even went to court. He still roams the streets and will do it again. I was told that they have his DNA on record and when he does it again, I may have to give evidence but they would not bring my case to court as they thought that I would not be able to with stand the cross examination. Not only was I raped I then had to go through a medical examination by a male doctor and then through 2 days of questioning of details that I wanted to forget. Then to cap it all because of details that I gave I had to go through a second medical examination, but thank god it was by a woman. Things have got to change drastically and they can castrate him and then hang him for all I care. He ruined my life. Its been 3 years and I cant even go out of by home by myself. |

we should all agree on the fact that any crime of extreme violence such as rape , murder etc warrents a death penalty.
but what if we execute an innocent person, which has happened many times. does that not make us guilty of murder?

good question...i think it's harsh,however there needs to be a serious shuffle where the whole judicial system is reconsidered as the punishments definately do not fit the crimes. |

This is a total perception issue. I think if you are the victim of a rapist you would probally feel that it is an appropriate punishment. If you are a rapist definitely to severe. My personal belief is that a first time rapist should be Physically castrated and given a 10 to 20 year sentence, unless the rapist is HIV positive then the punishment should be much more severe. A multiple offense rapist probally the death penalty. |

You need to define rape, as there are differing degrees and types. But in general our society has made a collective decision that the death penalty is to harsh a sentence for rapists. The death penalty may only be imposed in certain types of cases involving treason and certain types of murders (just a plain old murder won't do).
Now, there is currently a rash of states enacting these nonsensical laws calling for a death penalty in the event that someone is convicted of child molestation or rape. I expect those laws to be struck down by the state's own Supreme Court, or if it passes through there somehow then the U.S. Supreme Court. |
