I have a small estate affidavit that i need to submit to get processed, already submitted once and it was wrong. I had to pay over 200 bucks the first time and would like to make sure its correct this time. The attorney I went to tried to make me spend more than i was going to and all i wanna do it make sure this affidavit is correct.

Of the law libraries in Austin, i.e. State Capitol Law Library, the Supreme Court Law Library, the Travis County Law Library (in the Travis County Courthouse), and the U. of Texas School of Law Library, the most likely librarian help will be at the U. of Texas, then next at the Travis County Law Library, then next at the State Capitol, then lastly at the Supreme Court Law Library. Any one of the four will have sample small estate affidavits within their Wills, Estate and Probate form books. In years past, one could stop in unannounced and see if the Probate Court Consultant was not busy, and he would be friendly enough to answer simple questions on uncontested matters - you might try that also. |

Sorry, but there's no place to have it "checked" outside of an attorney's office because that constitutes the practice of law. Only attorneys are allowed to advise you on whether or not you've gotten it correct. The court clerks are prohibited by statute from giving any legal advice, so you can't depend on them for help - all they can tell you is whether or not they'll accept it.
Here's a thought - why don't you go back to the court house and ask the clerk if he/she can think of another case they've seen recently where there was a small estate affidavit? It'll be public record so you can get a copy and see how that person did it. No guarantees they did it right, but it might point you in the correct direction. |
