First if your state still has a law on the books prohibiting adultry, then it is not enforced. It may even be unconstitutional under some Supreme Court cases to enforce it. Strictly speaking, you will need to tell us the state so we can know 1) if there is still a law on the books even if it is not enforced (which it most surely is not) and 2) what the more or less irrelevant statute of limitations is. Also, as far as I know one cannot be sued by one's spouse or the person with whom one is adulterating because there is no tort providing a duty to not commit this (although there did use to be- men used to be able to sue the men who adulterated with their wives; back then it was seen as an invasion on your "chattel" (property)- yes women were considered property). But that is long behind us. I really wouldn't worry about criminal liability. If I were you, and I don't want to come accross as judgmental, but if I were you, I would be more concerned about patching things up, especially if there are kids involved. |

There is in the 10 Commandments, but not in the US Law. The only time it comes in play in courts is during divorce cases. Adultery in a marriage is ground for divorce and winning any settlement by the plaintiff. |

Adultry is not a crime punishible by law. However, Morally and ethically there is no limitation on how severe Adultry can damage anyone involved and how many layers deep it can cut. It effects those committing this moral and ethical crime as well as their children, close friends and relatives and for that there is no limitation. |

Adultery may still be illegal in some states however it is only because the legislature has failed to repeal it. Rarely if ever is it enforced as it is considered an outdated law. An on the rare occasion it is brought to court it is almost always thrown out. |

Adultry is a SIN (if you are a religious person) not a crime---you cannot get arrested for committing adultry---HOWEVER, if caught by your SPOUSE, you MIGHT be greeted at the door the next time you come home with a FRYING PAN to the face---which, WOULD be a crime---ASSAULT.... or if your spouse meets you at the door with a GUN and shoots you---it's a crime called ATTEMPTED MURDER---so, sins you can commit because you won't go to jail but Crimes---well you lose.. OH WAIT A SECOND----if going against the 10 commandments is a SIN, .... then THOU SHALT NOT KILL shouldn't be a crime either----oh well just proves that there are exceptions to every rule... Sin? Crime? |
