Is this a viable lawsuit?

My husband cut his hand very badly while putting back a knife that he was going to purchase from a culinary store, due to a poor arrangement of how they had the knifes displayed.. and the store associate allowed him to place the knife back onto the display case, even though it was poorly set up. He is getting subcutaneous and cutaneous stitches, and he bled all over the floor and all over his clothes. My question is, is this a viable lawsuit. The display was also a "locked" display case, you would think they would have been more cautious since these knives are very sharp.

Yes, it can be a suit for negligence by the store.

You can do either of two things.

1. Take this to the highest level in the company that you can. Tell the local manager that you want to talk to someone in the corporate level. Ask them to pay all medical and other bills associated with the problem. You also have to decide whether your husband wants to ask for "compensatory damages". That's a payment for his pain and suffering. If you're not satisfied with their response, then

2. Sue them.

DO NOT sign anything unless you read and understand it first.

Keep copies of all paperwork and notes of all conversations.

yuck....it's not clear just how bad his injuries are and if they are permanent in nature. the hand is a complex body part and a serious gash can have major consequences but maybe this is just a boo-boo. did he have to pay out of pocket for treatment or does he have a health plan? and did he miss any time from work for which he was not compensated? this sounds like a low-damages case but from what you've said about the arrangement of knives u could probably recover something.

Maybe your medical bills and dry cleaning of your dress. What if it happened in your home (they picked up a knife out of your draw). How would you like to be sued over an accident. why are people hell bent on suing each other. Is it personal responsibility not looking in what he was doing. Your husband pick the knife up through choice. He should of asked the shop assistant to show him.
