The primary justification given for copyright law is to give artists an incentive to produce by guaranteeing that they will benefit from the fruits of their labor. But in the case of the Star Wars Holiday Special it is being used to prevent the (legal) release of a movie. For those of you who are not familiar with it, the Star Wars Holiday Special was a flop – a horrible, embarrassing cheesy television movie that was broadcast on November 17, 1978 on CBS-TV from 8:00 p.m. to 10:00 p.m and never again legally broadcast anywhere. It was so bad that George Lucus is reported to have said "If I had the time and a sledgehammer, I would track down every copy of that show and smash it."
But, it has that quality of cheesiness that people often enjoy in the films of Ed Wood or classic Grade-B films of the 1950s. It is so bad in fact, that it is hilarious. And the fact it has so many stars in it makes the horrific writing all that much more poignant.
So my question is this, since the original producers are unwilling to accept payment for this film, isn’t it abuse of the purpose of copyright law to use it to prevent the release of this film.

Copyright law is so they have some control over their work, not just so they make money. So if they don't want it to be distributed, it doesn't have to be

No it is not an abuse if the copyright owner does not want to release it.
it is their prerogative. |

The owner of the copyright controls the material, so if they do not want it distributed, then it is illegal to distribute it.
You have to wait until the copyright runs out and the material enters the public domain, if the owner does not want to distribute the material.
Copyright expires four decades after the creator dies, as I recall. |
