Is this discrimination?

Well, i got a job at Zaxby's and they seemed real nice and i had forgotten my social security card and state ID, so i came back the next day to give it to him. (Yes i filled out all the new employee stuff.) So a week later i called him because i hadn't heard from him, though he said he'd call. But he was sick, and he was telling the truth, b/c he sounded like crap. Then i waited another week and then i called him again and he said he tried calling me. (I'm prepaid and my minutes ran out.) Then he says that he was in a rush to hire people and that i'm "not the right fit for them". Then the next day i found out that they'd hired a new person. a white person. what i want to know is, is this discrimination and how much can i get in a case of discrimination.

Okay, maybe i didn't type the question right. I got the job, legally. i was kept waiting for 2 whole weeks. but i never actually started, but I WAS LEGALLY HIRED. want to make that clear. but i was never put to work, but they hired another dude, a white one and now he has my job.

"Not the right fit for them" is not a racial remark. As long as he did not say "because you're a different color" or "because you're too old", I think you don't have a case at all. He has to show a clear discrimination in race, age, religious preference, gender, etc. They were rushing to look for an employee and your phone was out of minutes so they couldn't contact you. They have a just reason for not employing you. Good luck.

EDIT: Even if you were legally employed, the employment itself is "at will". That means that they have a right to fire/hire any employee for any reason without prior notice. You also have the right to quit the job anytime without notice or reason. Sorry but these facts still do not prove discrimination.

So you forgot things that you needed, your minutes ran out, and he couldn't get in touch with you, they got tired of waiting and hired someone.

Because of this, and the fact that they hired a 'white guy' you think you were discriminated against?

His comment of 'you aren't the right fit for them' most likely means they want someone who is responsible enough to keep their phone on and carry the proper ID. Maybe that's what the 'white guy' did.

Maybe this white person was easier to get hold of. I have hired people and if I cant get hold of them, and then try the next candidate and get hold of that person, quess what, they get the job.
This isnt discrimination.

Even if you didn't intend to, you became hard to reach, and, even accidental, if you were hard to contact in order to receive the job, the employer will start to think you would always be hard to get, and hiring someone that's hard to reach can hurt the business, and don't forget, there are many black people in the world, and there are many white people in the world, just because they hired a white person over you does not mean they are racist. White or black, they made themselves easy to reach and could have more experience in the field than you. Just because you didn't get a job doesn't give you the right to blame the employer, why would you try to ruin this guy's life and business, throw him onto the street, for making a good business decision. if a white man did that, he'd be denied that job too. People make mistakes, we're not perfect, just make sure you can get contacted next time you apply for a job, and don't attack someone for your own mistake. We all want to, but what's right should overrule revenge.
