Is this legal for me to do?

The last 2 years on New years eve some drunk driver has hit our Christmas decorations a hit and run. Now i set up a camera that records to my computer but u have another idea to set up a home made spike strip with nails by the decorations where it is likely to get hit. This way we can at least do some damage back if the car doesn't stop. Is this legal for me to do on my property?

I'm pretty sure they were drunk they went through both my neighbors' yards and hit another car parked in a drive way down the street.

If it is in your yard, on your property, I don't see why it would be illegal. Plus, who says that YOU are the one that put the nails out there. Actually, roofing nails work best. Just remember where you put them so that you don't step on them. They get what they deserve, and are they really going to rat themselves out?

This is a very bad idea.
It may be legal for you to do but think about what could happen.
Say you lay down a spike strip.
The only purpose you would have to do this is to damage this guys car, there's no other reason for having a spike strip there. If he ran it over and his tire blew out he could get seriously injured or killed because of you. This is not a crime however it is a tort. This has civil liability and any good lawyer would chew you up for this. Protecting your Christmas ornaments is not worth putting someone in the hospital and in doing so losing your house in his law suit.

No, its not illegal to record on your property.
But how can you prove that they were drunk?
By by causing an accident by using nails would be a crime.
I wouldn't have your decoration so close to the road. Maybe digging a hole or something to divert display becoming road kill.

While it may be legal, you also might be setting yourself up for a lawsuit if the driver is injured because of your spike strip. You want to be VERY careful in dealing with these kinds of morons in this litigation-happy society.

Take lots of pictures - best thing to do is take lots of pictures. One other thing you can do is to notify the local PD and see if they can put out some extra patrol in the area.

Stick to the cameras... not so sure about spikes, you could damage another car by mistake cause you can't wait up the whole night for that one person right?

How about just moving the decorations away form the path of an errant driver, or removing them altogether before New Years?

That's called entrapment which is illegal in most states. So I would check with the police department or somewhere like that so you don't get into trouble.

If it's on your property, I don't see why you couldn't put spike strips down.

It's a yard, not a street.


Edit: To the person below claiming this is entrapment. Do you know what entrapment means? Putting spikes in his yard is NOT entrapment. His decorations are NOT in the street. They are in his yard. The drunk has to drive in his yard to hit them.

I guess... It's your land. If you can plant a tree on it or put decorations up on it, you can put nails on it, as well. But there's a catch... He may sue (but probably won't win the case), and you'll have to pay to the damage done to his car.

absolutley, you can have any kind of defense set up around your property if it's just a physical barrior, As long as your not setting up any mine fields or arming guards with shot guns, you should be legally fine.

No this is not legal. You will be sued and handed your behind should someone get hurt.

I remember seeing a news story a couple of years ago about an electrician who was sick and tired of having his truck broken into at night while it was parked in his driveway. So he wired it up to high voltage. Seems he ran into big legal problems because apparently he needed to post a sign warning of the high voltage.

You may need to do something similar.
