At my sister's school in California her vice principal is collecting their cell phones out of their backpacks, and reading their text messages! Is this really legal?

It is NOT legal, in ANY form! If he thinks there is a saftey or drug problem, he would call the police, notify parents, and THEN the police MIGHT be able to check, IF they had parent permission and a warrant! Sounds like a pervert to me! |

If it's a public school, it's not if school officials had no reason to believe that they were violating any other school rule. (Private schools can make their own rules.)
Note that the nasty liberal ACLU came to the defense of a student in California for the same thing, explaining that the school district’s policy concerning cell phone searches violated the Fourth Amendment and the California Constitution.
The ACLU asked the district to revise the policy to conform to constitutional requirements and instruct school personnel that no student’s cell phone may be searched other than in compliance with the revised policy.
